P .BHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/02\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)<\/p>\n<p>1.0\tRule.\n<\/p>\n<p> Learned Additional Public Prosecutor Mr. KP Raval waives service of<br \/>\nprocess of Rule.\n<\/p>\n<p>2.0\tPresent<br \/>\napplication is filed through jail seeking Temporary Bail with a<br \/>\nCertificate of the Sarpanch of Navagam Gram Panchayat, Tal.<br \/>\nGhoghamba, Dist. Panchmahals stating therein that, &#8216;the mother of<br \/>\nthe accused &#8211; applicant is ill and there is no person in the<br \/>\nfamily to look after the aged mother.  It is the desire of the ailing<br \/>\nmother that she may be able to see the face of her son&#8217;.\n<\/p>\n<p>2.1\tComing<br \/>\nto the Jail Remarks, the accused &#8211; applicant has enjoyed two<br \/>\nfurloughs, one in the year 2008 and another in the year 2009.  On<br \/>\nboth the occasions, he surrendered in jail in time of his own.\n<\/p>\n<p>3.0\tTaking<br \/>\ninto consideration the above aspects, the application is allowed.<br \/>\nThe applicant &#8211; accused is ordered to be released on Temporary<br \/>\nBail for a period of 20 days from the date of his release<br \/>\nin Criminal Appeal No.444 of 2007 pending before this Court, on his<br \/>\nexecuting a personal bond of Rs.5,000\/- (Rupees Five Thousand Only)<br \/>\nto the satisfaction of the Jail authorities.\n<\/p>\n<p>3.1\tThe<br \/>\napplicant shall surrender to the Jail authorities on expiry of the<br \/>\nTemporary Bail period.\n<\/p>\n<p>3.2\tRule<br \/>\nis made absolute.\n<\/p>\n<p>[<br \/>\nRavi R.
