JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 28\/04\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tWhen<br \/>\nthe matter is taken up today, Mr. Yogen Pandya, learned advocate for<br \/>\nthe petitioner submits that it appears from the affidavit-in-reply<br \/>\nfiled by the respondent-Corporation that a Revision Application under<br \/>\nSection 451 of the Bombay Provincial Municipal Corporation Act, 1949,<br \/>\nhas been filed by the respondent against the order of the Standing<br \/>\nCommittee dated 02.03.2009. It is further submitted that neither has<br \/>\nthe petitioner been informed regarding the filing of the petition,<br \/>\nnor has any order been placed on the record of the case, whereby the<br \/>\norder of the Standing Committee has been either modified or stayed.<br \/>\nThat this Court in the case of Narayan Sadhashiv Mohite Vs.<br \/>\nBaroda  Municipal Corporation &amp; Another, 1992(2)<br \/>\nGLR 1559 has held that the powers of the Standing Committee<br \/>\nare wide in nature. Therefore, the order of reinstatement of the<br \/>\npetitioner ought to have been implemented by the<br \/>\nrespondent-Corporation. It is further submitted that the Revision has<br \/>\nbeen preferred by the respondent-Corporation behind the back of the<br \/>\npetitioner and the petitioner has only come to know about the same<br \/>\nafter reading the averments contained in the affidavit-in-reply. As<br \/>\norder of the Standing Committee has not been stayed or modified by<br \/>\nthe State Government, the same ought to be implemented as mere filing<br \/>\nof a Revision Application will not nullify the said order.\n<\/p>\n<p>\tOn<br \/>\nthe other hand Mr. Satyam Chhaya,learned advocate for the<br \/>\nrespondent-Corporation has submitted that the Corporation has moved<br \/>\nthe State Government under the provisions of Section 451 of Bombay<br \/>\nProvincial Municipal Corporation Act, 1949, on 29.08.2009, however,<br \/>\nno orders have been passed by the State Government on the said<br \/>\nRevision Application, till date. Mr. Chhaya, learned advocate for the<br \/>\nrespondent-Corporation has brought to the notice of this Court<br \/>\njudgment in the case of Manhar T.
