Heard the learned counsels for the<\/p>\n<p>                   petitioner and the State.\n<\/p>\n<p>                              The     petitioner       being    the    P.D.S.<\/p>\n<p>                   dealer is apprehending his arrest in a case<\/p>\n<p>                   registered under Section 406 of the Indian<\/p>\n<p>                   Penal Code and Section 7 of the Essential<\/p>\n<p>                   Commodities Act.\n<\/p>\n<p>                              On    15.07.2009,     raid      was    conducted<\/p>\n<p>                   and huge quantity of grains and Kerosene Oil<\/p>\n<p>                   were found in the stock of the petitioner,<\/p>\n<p>                   hence, it was suspected that the grains were<\/p>\n<p>                   to be used for black marketing.<\/p>\n<p>                              It    is     submitted     by    the    learned<\/p>\n<p>                   counsel      for        the   petitioner         that   the<\/p>\n<p>                   petitioner lifted Kerosene Oil on 10.07.2009<\/p>\n<p>                   and food grains were lifted on 06.07.2009<\/p>\n<p>                   and 15.07.2009 and part of distribution was<\/p>\n<p>                   made but rest was lying in the stock. Hence,<\/p>\n<p>                   seizure constituted neither any offence nor<\/p>\n<p>                   it     amounts     to    violation    of    any     Control<\/p>\n<p>                   Order. Moreover, the P.D.S license of the<\/p>\n<p>                   petitioner has been put under suspension and<\/p>\n<p>                   enquiry is going on.\n<\/p>\n<p><span class=\"hidden_text\">                           2<\/span><\/p>\n<p>                  Considering the aforesaid facts, let<\/p>\n<p>        the petitioner, above named, be released on<\/p>\n<p>        bail in the event of            arrest or       surrender<\/p>\n<p>        before    the    learned      court   below     within     a<\/p>\n<p>        period    of     twelve     weeks     from      today      in<\/p>\n<p>        connection with Maniyari P.S. Case No. 83 of<\/p>\n<p>        2009 on furnishing bail bond of Rs.10,000\/-<\/p>\n<p>        (Ten Thousand) with two sureties of the like<\/p>\n<p>        amount    each    to    the     satisfaction      of    the<\/p>\n<p>        learned         S.D.J.M.,(West),           Muzaffarpur,<\/p>\n<p>        subject to the conditions as laid down under<\/p>\n<p>        Section    438(2)      of     the   Code   of    Criminal<\/p>\n<p>        Procedure.\n<\/p>\n<p>U.
