No.2374 of 2008\n           -------------------------------------------------\n          Dated this the 24th day of June, 2008\n\n                              ORDER\n<\/pre>\n<p>     The petitioners face indictment in a prosecution for<\/p>\n<p>offence punishable under Sec.324 read with Sec.34 of the IPC.<\/p>\n<p>The crime was registered in 1999. Final report has been filed.<\/p>\n<p>Cognizance has been taken.         The petitioners have not been<\/p>\n<p>arrested so far.   They have not appeared before the learned<\/p>\n<p>Magistrate. In these circumstances, coercive processes have<\/p>\n<p>been issued against the petitioners by the learned Magistrate.<\/p>\n<p>Such coercive processes chasing the petitioners now.           They<\/p>\n<p>apprehend imminent arrest.\n<\/p>\n<p>     2. According to the petitioners, they are absolutely<\/p>\n<p>innocent.  Their absence earlier was not wilful or deliberate.<\/p>\n<p>The petitioners, in these circumstances, want to surrender<\/p>\n<p>before the learned Magistrate and seek regular bail.           The<\/p>\n<p><span class=\"hidden_text\"> Crl.M.C. No.2374 of 2008 -: 2 :-<\/span><\/p>\n<p>petitioners apprehend that their applications for regular bail may<\/p>\n<p>not be considered by the learned Magistrate on merits, in<\/p>\n<p>accordance with law and expeditiously.           It is, in these<\/p>\n<p>circumstances, that the petitioners have come to this Court for a<\/p>\n<p>direction to the learned Magistrate to release them on bail when<\/p>\n<p>they appear before the learned Magistrate.<\/p>\n<p>       3.   It is for the petitioners to appear before the learned<\/p>\n<p>Magistrate    and    explain   to  the   learned  Magistrate   the<\/p>\n<p>circumstances under which they could not earlier appear before<\/p>\n<p>the learned Magistrate. I have no reason to assume that the<\/p>\n<p>learned   Magistrate     would   not   consider  the   petitioners&#8217;<\/p>\n<p>applications for regular bail on merits, in accordance with law<\/p>\n<p>and expeditiously.     No special or specific directions appear to<\/p>\n<p>be necessary. Every court must do the same. Sufficient general<\/p>\n<p>directions on this aspect have already been issued in the decision<\/p>\n<p>reported in <a href=\"\/doc\/147290035\/\">Alice George v. Deputy Superintendent of Police<\/a><\/p>\n<p>(2003 (1) KLT 339).\n<\/p>\n<p>      4.   In the result, this Crl.M.C. is dismissed; but with the<\/p>\n<p>observation that if the petitioners surrender before the learned<\/p>\n<p>Magistrate and seek bail, after giving sufficient prior notice to<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No.2374 of 2008 -: 3 :-<\/span><\/p>\n<p>the Prosecutor in charge of the case, the learned Magistrate<\/p>\n<p>must proceed to pass appropriate orders on merits and<\/p>\n<p>expeditiously &#8211; on the date of surrender itself.<\/p>\n<p>                                       (R.
