SHAH\n\t\t\n\t\n\n \n\nDate\n: 21\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Article 226 of the Constitution<br \/>\nof India, the petitioner has prayed for an appropriate writ,<br \/>\norder and\/or direction, quashing and setting aside the impugned<br \/>\nNotices dated 17.2.2011 and 22.2.2011 issued by respondent No.2 and<br \/>\nfurther prayed to direct respondent No.2 to issue No Objection<br \/>\nCertificate to the petitioner for installation of Mobile Tower at<br \/>\nVrajdham Apartment, Dahod.\n<\/p>\n<p>2.\t\tMr.D.K.Puj,<br \/>\nlearned advocate appearing on behalf of the petitioner does not press<br \/>\nthe relief sought in the present petition, however, he has requested<br \/>\nto direct the respondent &#8211; Nagarpalika to issue requisite NOC,<br \/>\nwhich is sought vide applications dated 06-01-2011\/04-02-2011 for<br \/>\nrestoration of the mobile tower at Vrajdham Apartment, Dahod and if<br \/>\nthe same is in order and there are no objections.\n<\/p>\n<p>3.\t\tIn<br \/>\nview of the above, the present petition is disposed of by directing<br \/>\nthe respondent &#8211; Nagarpalika to consider the applications of<br \/>\nthe petitioner dated 06-01-2011\/04-02-2011 in accordance with law and<br \/>\non merits within a period of four weeks from the date of receipt of<br \/>\nwrit of this order and if the same is in order and there are no<br \/>\nobjections, the same may be considered and final order may be passed<br \/>\nwithin stipulated time as stated hereinabove. If still there are any<br \/>\nqueries and\/or objections, the petitioner may be communicated<br \/>\naccordingly and on removal of such queries\/ objections, appropriate<br \/>\ndecision may be taken by the respondent &#8211; Nagarpalika in<br \/>\naccordance with law and on its own merits, after following due<br \/>\nprocedure as required.\n<\/p>\n<p>\t\tWith<br \/>\nthis, the present petition is disposed of.
