THE JOINT STATE TRANSPORT COMMISSIONER, BIHAR, PATNA\n                               -----------\n<\/pre>\n<p>02.   14.09.2010             Heard learned counsel for the petitioner and<\/p>\n<p>                   learned counsel for the State.\n<\/p>\n<p>                             The petitioner is stated to have joined<\/p>\n<p>                   service in the year 1984. As on 11.9.2008, when he<\/p>\n<p>                   was granted V.R.S. under Rule 74 (b) of the Bihar<\/p>\n<p>                   Service Code, he fulfilled the conditions for the same.<\/p>\n<p>                             On    9.2.2003    he    was    placed    under<\/p>\n<p>                   suspension, while on deputation in the Transport<\/p>\n<p>                   Department for less revenue collection. Charges were<\/p>\n<p>                   framed on 11.3.2003 replied to by him on 5.4.2003.<\/p>\n<p>                   On 14.1.2004 he was sent back to his parent (Home)<\/p>\n<p>                   department. He represented on 7.2.2007 that the<\/p>\n<p>                   departmental proceedings were still pending. On<\/p>\n<p>                   21.4.2008 the order of suspension was revoked by the<\/p>\n<p>                   parent (Home) department with directions to expedite<\/p>\n<p>                   the departmental proceedings.\n<\/p>\n<p>                             He applied for V.R.S. on 4.8.2008. This<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>application was allowed by Letter No. 1577 of 2009 on<\/p>\n<p>11.09.2008 with effect from 30.9.2008.<\/p>\n<p>            Learned counsel for the petitioner questions<\/p>\n<p>the continuance of the departmental proceedings even<\/p>\n<p>thereafter affecting his retiral benefits.<\/p>\n<p>            Learned counsel for the State prays for time<\/p>\n<p>to seek instruction and\/or issuance of directions to<\/p>\n<p>conclude the departmental proceedings expeditiously.<\/p>\n<p>            The writ petition raises a pure question of<\/p>\n<p>law. Rule 74 (b) of the Bihar Service Code reads as<\/p>\n<p>follows:-\n<\/p>\n<blockquote><p>                       &#8220;74 (b) (i). Notwithstanding<br \/>\n            anything contained in the preceding<br \/>\n            sub-rule, a Government servant may,<br \/>\n            after giving at least three months<br \/>\n            previous notice, in writing, to the<br \/>\n            appointing authority concerned retire<br \/>\n            from service on the date on which such<br \/>\n            a Government servant completes thirty<br \/>\n            years of qualifying service or attains fifty<br \/>\n            years of age or on any date thereafter to<br \/>\n            be specified in the notice:\n<\/p><\/blockquote>\n<blockquote><p>                       Provided that no Government<br \/>\n            servant under suspension shall retire<br \/>\n            from service except with the specific<br \/>\n            approval of the State Government.&#8221;<\/p><\/blockquote>\n<p>            If the respondents had chosen not to accept<\/p>\n<p>his application for Voluntary Retirement in view of the<\/p>\n<p>pendency of the departmental proceedings, matters<\/p>\n<p>would have been entirely different. If the petitioner was<\/p>\n<p>making a claim for a deemed retirement under Rule 74<\/p>\n<p>(b) on expiry of the period of three months of notice,<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>again matters have been very different. But when the<\/p>\n<p>respondents by a conscious executive decision accept<\/p>\n<p>his request for Voluntary Retirement and relieved him,<\/p>\n<p>the master servant relationship stood severed. If the<\/p>\n<p>master   servant   relationship     stood   severed        by   a<\/p>\n<p>conscious act of the respondents, the petitioner<\/p>\n<p>remains no more a Government servant amenable to<\/p>\n<p>proceedings under the service Rules.<\/p>\n<p>          The   allegations   did    not    relate    to    any<\/p>\n<p>financial misappropriation or embezzlement or gross<\/p>\n<p>misconduct. The petitioner has been allowed Voluntary<\/p>\n<p>Retirement by a conscious policy decision during the<\/p>\n<p>pendency of the proceedings. A presumption arises<\/p>\n<p>that the respondents themselves did not consider it a<\/p>\n<p>matter serious enough to continue with the master<\/p>\n<p>servant relationship for the purposes of a departmental<\/p>\n<p>proceedings.\n<\/p>\n<p>          The      suspension        and      departmental<\/p>\n<p>proceedings are deemed to have ended by necessary<\/p>\n<p>implication from the date of his voluntary retirement.<\/p>\n<p>          The order of suspension dated 9.2.2003 and<\/p>\n<p>the departmental proceedings are therefore held to be<\/p>\n<p>no more sustainable or existing with effect from the<\/p>\n<p>date of retirement. If the respondents have not<\/p>\n<p>initiated any proceedings under 43 (b) of the Pension<br \/>\n<span class=\"hidden_text\">                            4<\/span><\/p>\n<p>       Rules against the petitioner prior to the institution of<\/p>\n<p>       the writ application on 17.2.2010 they are precluded<\/p>\n<p>       from doing so.\n<\/p>\n<p>                    The application stands conditionally allowed<\/p>\n<p>       and the petitioner is held entitled to his post<\/p>\n<p>       retirement benefits subject to the fulfillment of the<\/p>\n<p>       condition.\n<\/p>\n<p>                    The application is allowed.\n<\/p>\n<\/p>\n<pre>P.K.
