\nto amend. Amendment be carried out forthwith.\n<\/p>\n
2.\tThis
\nis an application preferred under Section 439 of the Code of Criminal
\nProcedure, 1973 by the applicant for regular bail, who has been
\narrested, in connection with F.I.R. registered as  C.R. No. I-133 of
\n2009 with Limkheda Police Station for the offence punishable under
\nSections  143, 365, 302 and 34 of the Indian Penal Code.\n<\/p>\n
3.\tLearned
\nadvocate for the applicant submitted that the applicant is an
\ninnocent person and false case is foisted on him punishable under
\nSections 143, 365, 302 and 34 of the Indian Penal Code. Learned
\nadvocate further submitted that considering the role attributed  to
\nthe applicant as reflected in F.I.R. at Annexure-A to the application
\nand since the co-accused have already been released by this Court
\nvide order dated 09.02.2010 passed in Criminal Misc. Application No.
\n140 of 2010, the applicant even, on the ground of parity, deserve to
\nbe enlarged on bail.\n<\/p>\n
4.\tLearned
\nA.P.P. Mr. D.C. Sejpal, representing the State, while opposing the
\nbail application, submitted that the applicant is involved in a
\nserious offence punishable under Sections 143, 365, 302 and 34 of the
\nIndian Penal Code. Learned A.P.P. further submitted that considering
\nthe role attributed to the applicant and the manner in which the
\noffence is committed by him along with other accused, no
\ndiscretionary relief be granted to the applicant and the application
\ndeserves to be dismissed.\n<\/p>\n

\nhave heard learned advocate Mr. M.A. Kharadi appearing for the
\napplicant and learned A.P.P. Mr. D.C. Sejpal appearing for the State
\nat length and in great detail. I have considered the rival
\nsubmissions, averments made in the application, role attributed to
\nthe applicant which is reflected in F.I.R. at Annexure-A to the
\napplication, provisions of Sections  143, 365, 302 and 34 of the
\nIndian Penal Code, quantum of punishment, police papers, statement of
\nwitnesses etc. and the fact that the co-accused have already been
\nenlarged on bail by this Court vide order dated 09.02.2010 passed in
\nCriminal Misc. Application No. 140 of 2010, I am of the view that the
\npresent applicant also deserve to be enlarged on bail.\n<\/p>\n
6.\tIn
\nthe facts and circumstances of the case, the application is allowed
\nand the applicant is ordered to be enlarged on bail in connection
\nwith  C.R. No. I-133 of 2009 registered at Limkheda Police Station on
\nexecuting a bond of Rs. 10,000\/- (Rupees twenty thousand only) with
\none surety of the like amount to the satisfaction of the Trial Court
\nand subject to the conditions that he shall:\n<\/p>\n
(a)\tnot
\ntake undue advantage of  his liberty or \tabuse his liberty;\n<\/p>\n
(b)\tnot
\nact in a manner injurious to the interest of \tthe\tprosecution;\n<\/p>\n
(c)\tsurrender
\nhis passport, if any, to the lower \tcourt within \ta week.\n<\/p>\n
(d)\tnot
\nleave the State of Gujarat without the prior \tpermission of the
\nSessions Court concerned;\n<\/p>\n
(e)\tmark
\nhis presence at Limkheda Police Station on \tany day of every first
\nweek of \tEnglish calendar \tmonth between 9.00 AM and \t2.00 PM. till
\nthe \ttrial is over;\n<\/p>\n
(f)\tfurnish
\nthe present address of his residence \tto \tthe I.O.\tand \talso to the
\nCourt at the time \tof \texecution of the \tbond and shall not change
\n\this \tresidence without prior permission of this \tCourt;\n<\/p>\n
(g)\tmaintain
\nlaw and order.\n<\/p>\n
7.\tIf
\nbreach of any of the above conditions is committed, the Sessions
\nJudge concerned will be free to issue warrant or to take appropriate
\naction in the matter.\n<\/p>\n
8.\tBail
\nbond to be executed before the lower Court having jurisdiction to try
\nthe case.\n<\/p>\n
9.\tAt
\nthe trial, the Trial Court shall not be influenced by the
\nobservations of preliminary nature, qua the evidence at this stage,
\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n
10.\tRule
\nis made absolute to the aforesaid extent. \tDirect Service is
\npermitted.\n<\/p>\n
