 primary facts of the case as stated in the<\/p>\n
“rnemo_.ra:ndum of appeal are as under:<\/p>\n

That on 18.8.2006 one T.K. Krishna, who is the son of the<\/p>\n
appellants was travelling as a bonafide passenger En.g–‘H.gbli<\/p>\n
Bangalore passenger train (Train No.582) and he was V.<\/p>\n
a valid journey ticket to travel from Ajjampur to Aresikerre; <\/p>\n
was lost. The train was overcrowded’an’d’~the deceased’was”‘.<\/p>\n
forced to stand near the door and as  train toQ’k”a <\/p>\n
Banavar Railway Station, the decease:5~–ifell  train V<\/p>\n
by losing his balance and'”s.l_i&pped'””acclduentally”a’nd'”Vseverely
\ninjured and died. The apple;-larrtsvlvhaveg\ufb01lledlllppetition in O.A.<\/p>\n

4. Thei\ufb01sum’ alndvsu_yl\u00a7’stgance—-of’ the finding of the Tribunal is
\nas under:\n<\/p>\n
 The._firEbunal considering the oral and documentary<\/p>\n
evidenceandwAalsoithe materials placed on record, has awarded a<\/p>\n
 complen\u00e9re:le\u00abeh I&;\u00a7g’r<\u00e9\u00a7cl.4';oo,ooo\/~ for the death of the deceased<\/p>\n
Vftogether vvith"–.'l:nte'Eest thereon at 9% per annum from the date of<\/p>\n
 Order till the date of actual payment.\n<\/p>\n
—   ll’-‘eeling aggrieved by the impugned order, the appellants<\/p>\n
 ‘   the legal representatives of the deceased T.K. Krishna, have<\/p>\n
ex’<\/p>\n
preferred this appeal. In this appeal, the appellants attackedthe<\/p>\n
order pertaining to award of interest from the date of<\/p>\n
6. Learned counsel for the appellant subrn”i”ts that <\/p>\n
Railway Claims Tribunal has awarded in:teAre’straVt’~9% <\/p>\n
from the date of the Judgment and _C)rcleiv._til’l-._the date’ of amine.<\/p>\n
payment. He further submits that  ‘was
\nfiled before the Claims Tribun’a.l_  resp’ondent has
\nfiled its reply on 27.7.2007  of on
\n27.6.2008. Therero.reCi.ritterei;?\u00a7t  to’::’t.ie–..a_ig.}iarded at 9% per<\/p>\n
annum from the tillithe date of order. In<\/p>\n
support of his c0a1ten’ti\u00e9.0n;’he”-relies’ on the unreported judgment
\nof this Court in–___the  Rachamma and others .vs.<\/p>\n

“‘iv.”;._:8.:T_he’oniy question that arises for my consideration is<\/p>\n
 appellants are entitled for interest from the date of<\/p>\n

application or from the date of the order. My answer to the<\/p>\n
above question is as under for the foiiowing reasons:<\/p>\n
9. As per Section–2 of the Interest Act, 1978, V’<\/p>\n
context otherwise requires, “Court” inciudes a Trib’unai,j;anid’banjo ”<\/p>\n
Arbitrator.\n<\/p>\n
10. Section~–3 of the Interest’\/Act  <\/p>\n

proceeding   debt or damages<\/p>\n

\n'rate  the current rate of interest, for

,j.=said.]decis.i.onV."' In the said decision, this Court has awarded<\/p>\n
 from the date of filing the claim application. As stated<\/p>\n
if<\/p>\n
earlier, Section\u00bb-2 of the Interest Act includes a Tribunal and an<\/p>\n
Arbitrator. Section\u00bb~3 of the Interest Act permits the Court to<\/p>\n
allow interest. Therefore the Tribunal can award interest.<\/p>\n
the discretion is left to the Tribunal and the  <\/p>\n
award interest having regard to the factsanri ,circurnlst'ances.~ of<\/p>\n
the case. In the instant case, thoughlA"the—-_c'lainil"petition'<\/p>\n
presented on 12.12.2006, the reslpondegnt has.filedj'v_,its~rVrepl$,r on I I<\/p>\n

\nprotracted,  set up a specialized Tribunal
\nfor speedy,'a_djudi'cati'on_Gf s'dcVh""ciaims. The setting up of such a
\nC'laVims,T'-ribunal with "xB"enc'i*i7es in different parts of the country,<\/p>\n
  'technical members, will provide much relief<\/p>\n
 the rai_l4:\u00a7users"by*way of expeditious payment of compensation<\/p>\n
 victims of rail-accidents and to those whose goods are lost<\/p>\n
