Application No. 1568 of<br \/>\n2010.\n<\/p>\n<p>2.0\tThe<br \/>\nrespondents came to eb arrestd on 22.03.2010 in connection with<br \/>\noffence registered with Kamrej Police Station, Surat being I-C.R. No.<br \/>\n37 of 2010 for the offence punishable under Sections 120 (B), 121(A),<br \/>\n124(A) and 153 (A)(B) of the Indian Penal Code and under Sections 38,<br \/>\n39 and 40 of the Unlawful Activities (Prevention) Amendment Act,<br \/>\n2004. The respondent-accused preferred an application for regular<br \/>\nbail which came to be allowed by order passed below Exh. 1 dated<br \/>\n17.09.2010 passed by the learned Sessions Judge, Surat in Criminal<br \/>\nMisc. Application No. 1568 of 2010. It is the said order which is<br \/>\nchallenged in the present application.\n<\/p>\n<p>3.0\tHeard<br \/>\nlearned advocates for the respective parties.\n<\/p>\n<p>4.0<br \/>\nThe main grounds urged for cancellation of bail on the grounds are<br \/>\nthat in the statement of co-accused, name of accused person was<br \/>\nrevealed and in T.I. Parade he was identified; that the involvement<br \/>\nof the accused is proved and activities of accused ought to have been<br \/>\nviewed seriously; that the accused had played vital role by giving<br \/>\naccomodation to one of the accused Avinash Kulkarni and that the<br \/>\naccused persons used to constitute unlawful assembly with an<br \/>\nintention of spreading antisocial and anti-national activities to<br \/>\nspread the maoist activities.\n<\/p>\n<p>5.0\tOrdinarily<br \/>\nthe High Court cannot exercise its discretion to interfere with the<br \/>\nbail granted by the Sessions Judge in favour of the accused and where<br \/>\ncancellation of bail is sought in an application, the prosecution has<br \/>\nto prove its allegation by preponderance of probabilities.<br \/>\nCancellation of bail necessarily involves the review of a decision<br \/>\nalready made and can by and large be permitted only if by reason of<br \/>\nsupervening circumstances. It would not be conducive to a fair trial<br \/>\nto allow the accused to retain his freedom during the trial. A bail<br \/>\nonce granted cannot be cancelled on the off-chance or on the<br \/>\nsupposition that witnesses have been won over by the accused. The<br \/>\npower to take back to custody an accuse who has been enlarged on bail<br \/>\nhas to be exercised with care and circumspection. Very cogent and<br \/>\noverwhelming circumstances are necessary for an order seeking<br \/>\ncancellation of the bail and the trend today is towards granting bail<br \/>\nbecause it is now well settled that the power to grant bail is not to<br \/>\nexercise as a punishment before trial. The material considerations in<br \/>\nsuch a situation are whether the accused would be readily available<br \/>\nfor his trial and whether he is likely to abuse the discretion<br \/>\ngranted in his favour by tampering with the evidence. While<br \/>\nconsidering the application for cancelling a bail the Court has to<br \/>\nsee whether the accused tampers with the prosecution evidence or<br \/>\notherwise impedes the course of justice, whether fresh evidence for<br \/>\nbelieving that the accused has been guilty of an offence punishable<br \/>\nwith death or imprisonment for life has been discovered; whether the<br \/>\naccused runs to a foreign country or goes underground or beyond the<br \/>\ncontrol of his sureties or whether he commits acts of violence, in<br \/>\nrevenge, against the police and the prosecution witness and those who<br \/>\nhave booked him or are trying to book him.\n<\/p>\n<p>6.0\tOn<br \/>\nthe facts of the present case, none of the aforesaid ingredients has<br \/>\nbeen pointed out to support the contention of the applicant to cancel<br \/>\nthe bail. The applicant has failed to establish its case by showing a<br \/>\npreponderant of probabilities and not beyond reasonable doubt, that<br \/>\nthe accused has attempted with its witnesses, or has abused his<br \/>\nliberty or that there is a reasonable apprehension that he will<br \/>\ninterfere with the course of justice. The Sessions Court has<br \/>\nconsidered all the facts and circumstances of the case while granting<br \/>\nbail. It is also required to be noted that this Court has granted<br \/>\nbail to co-accused by order dated 18.11.2010 in Criminal Misc.<br \/>\nApplication No. 12435 of 2010 and other allied matters. However, in<br \/>\nthe interest of justice, it is ordered that the respondent-accused<br \/>\nshall report to the concerned police station once in every three<br \/>\nmonths I.e.
