the other appellants, having-sostainled. ..1n~’3a
\nvehicle accident, died   petition filed
\nunder Seo.166 of beenllpailowed by the MACT
\nin part. CoVrripe_nsaf\u00a7i{3’I’]:\u00bb  determined at
\n   30% contributory<\/p>\n
negli’gen_cexVof’~the”dece’as_ed.5- Abdulla, Rs.1,’77,000\/– was<\/p>\n
deductedland  Rs.4, 13,000\/– has been made.<\/p>\n
 the’-petitioners have preferred this appeal.<\/p>\n
 he ” ‘Heard the learned Counsel on both sides and<\/p>\n
perused’ records.\n<\/p>\n
” h “3:  Learned Counsel for the appellants contended<\/p>\n
  it that the Tribunal has committed an error in holding that<\/p>\n
 is 30% contributory r1egliger1oEby the deceased —<\/p>\n
,\/’<\/p>\n
Abdu\ufb01a. He further contended that the loss of
\ndependency assessed by the Tribunal is on Iowerfside and<\/p>\n
there is no just award by the Tribunal.<\/p>\n
4. Per contra, Sri.O.Mahes_h, the”1’ea1jn’ed C.ounsei:”~..<\/p>\n
appearing for the second responde’nit~”–   ”<\/p>\n

\nof occurrence, contends  rtas only on
\naccount of rash  vehicle by the
\ndeceased –‘_Ai::dui1a.;:””‘that this is a case
\nwherein,   to be attributed to
\nthe  further contended that,
\nwithout  being placed on record,<\/p>\n
 “ha_S_______taken the income of the deceased at<\/p>\n

that  ‘th_e,..3’tacts and material circumstances, the award<\/p>\n
 passedjbgf the Tribunal is just compensation.<\/p>\n

the only bread earner in the family. Tribunal<\/p>\n
the income of the deceased at Rs.5,000\/–,  4_<\/p>\n
