2. The 3″‘ respondent herein \u00ab\u00abM.K.Rangappa<\/p>\n
was in the employment of the appellant –BMT{3’<\/p>\n
retired from service on 31.8.2004.   <\/p>\n
application under Section 4 of th’e-Payrrieritj”of4_Gratuity ‘<\/p>\n
Act, 1972 before the Controlling\u00abVAiithority.,for, <\/p>\n
of Gratuity, averring thatlthi:::\u00a7~~..\u00a7\/iyfatnity <\/p>\n
to him had not been zleterrninedi’inV”accordar1ce”iwith law.
\nSince there was  an
\napplication  delay. The 2115
\nrespondent’   and allowed the
\napplic!a’tion.l.filled’:by”  bf\u00e9\u00e9plondent herein by order
\n same was confirmed by the<\/p>\n

 Beingwiaggrieved by the same, BMTC<\/p>\n
   13878\/2008 contending that the order<\/p>\n
passed.by_the 151 respondent confirming the order of the<\/p>\n

 -gr-a.tli;1ity amount of Rs.55,908\/– to the 8″ respondent<\/p>\n

3. The iearned Single Judge, after hearing the<\/p>\n
iearned Counsel appearing for the petitioner -appe11ant
\nherein. the iearned Government. Advocate appearing for<\/p>\n
respondent Nos.I. and 2 and the 1earned..j”eoLi1i–sel<\/p>\n
appearing for the 3″‘ respondent, by <\/p>\n
9.3.2009, held that the Service..Regi4ster’Hdioes1no”t.’pVroV_eu it<\/p>\n
as to how many days the workfnan has hworeked <\/p>\n
such circumstances, in the.._Va’e._sencVe .__of any evidence to”<\/p>\n
prove the same, the oniy inrferenCe”-~that eou1d5he drawn<\/p>\n
is that the   for 240 days<\/p>\n
contij;inon’si_\u00a7f’.gviniiiad  andvddentitied for gratuity. The
\n{earned $1-ngle  heid that the fact that the<\/p>\n
applicant ‘wori\u00e9ed\u00e9vas conductor from 4.12.1967 to<\/p>\n
‘d it   is notwinddispute and if there was any break<\/p>\n
   vhVt1~’ie.~saIr1e ought to have been proved by the<\/p>\n
rnanagvement. The same has not been proved and<\/p>\n
 ewherefore the order passed by respondent Nos}. and 2<\/p>\n
it j-“dstitied. However, the {earned Single Judge made<\/p>\n
 ” ~-~~observations regarding the conduct of the 21″-1<\/p>\n
respondent in disbursing the amount without waiting<\/p>\n

for the result of the appeal filed before the ls’-
\nrespondent and accordingly disposed of the.___ writ
\npetition. Being aggrieved by the said order, <\/p>\n
appeal is filed by the BMTC.\n<\/p>\n

and the 'learned Single Judge ought to have allowed the<\/p>\n

contention of the 1earned;c_ounse1_’for thve-“\u00abl.p:a’rties’; <\/p>\n
scrutinised the material on record,\n<\/p>\n
8. The material on  clearly show
\nthat respondent  put in 38<\/p>\n
 he was drawing basic
\nsalaryvllof  date of superannuation<\/p>\n
ar1d_-BMTC” v_ifas..vl”ecl}”‘s-iilred to pay Rs.2,83,860\/\u00ab, but it<\/p>\n
f>a1’d”._onlylv”lRs;,2,27,952\/w contending that the<\/p>\n
 ” worked for one year 10 months 5<\/p>\n
days a’s}d,in order to claim gratuity. the workman must<\/p>\n
 havellwoirked at least 240 days continuously during the<\/p>\n
it  1967 and 1972 and that having not proved by<\/p>\n
 ”  workman, he is not entitled for payment. of gratuity.<\/p>\n
It is clear from the scrutiny of the material on record<\/p>\n
