Admit the appeal. Call for the Lower Court Record of Sessions<\/p>\n<p>                     Trial No.86 of 2007 from the court of Additional Sessions Judge,<\/p>\n<p>                     F.T.C.NO.3, Nalanda at Biharsharif.\n<\/p>\n<p>                                 The appellant has been convicted under Section 302\/34 of the<\/p>\n<p>                     IPC and 27 of the Arms Act. Counsel for the appellant submits that the<\/p>\n<p>                     appellant is an order giver and accused Surendra Yadav has fired from his<\/p>\n<p>                     pistol on the deceased.\n<\/p>\n<p>                                 Considering the aforesaid facts, prayer for bail of the appellant<\/p>\n<p>                     is allowed. During the pendency of this appeal, let the appellant, namely,<\/p>\n<p>                     Subelal Yadav be released on bail on furnishing bail bond of Rs.10,000\/-<\/p>\n<p>                     (ten thousand) with two sureties of the like amount each to the satisfaction<\/p>\n<p>                     of Sri Ashok Kumar Singh, Additional District &amp; Sessions Judge, Fast<\/p>\n<p>                     Track Court No.III, Nalanda, Biharsharif in connection with Sessions Trial<\/p>\n<p>                     No.86 of 2007 arising out of Sarmera P.S.case No.18 of 2006.<\/p>\n<p>                                 The realization of fine shall remain stayed.<\/p>\n<pre>\n\n\n\n                                          ( Mridula Mishra,J. )\n\n\n\n     B.Kr.
