(Oral)\n<\/pre>\n<p>             The appellant was, in the first instance, proceeded against<\/p>\n<p>departmentally for the following charges:-\n<\/p>\n<blockquote><p>      &#8220;(1) that when his bus was checked on way to Delhi from Mukatsar<\/p>\n<p>             between Malour and Dabwali, it was discovered although three<\/p>\n<p>             passengers were travelling from Mukatsar to Delhi two from<\/p>\n<p>             Mukatsar to Rohtak and one from Mukatsar to Hissar all of<\/p>\n<p>             them had been charged from Delhi but given tickets for Sirsa<\/p>\n<p>             and had in the process embezzled from Rs.85.25 ps.<\/p>\n<p>      (2)    that when the case in hand with the workman was checked on<\/p>\n<p>             18.6.79 on his return trip from Delhi it was found in excess of<\/p>\n<p>             the sale proceeds of the tickets by Rs.102.32 ps. Suggesting<br \/>\n<span class=\"hidden_text\"> LPA No. 241 of 2009                                                      2<\/span><\/p>\n<p>            that he had charged certain passengers without issuing them the<\/p>\n<p>            requisite tickets; and<\/p>\n<p>      (3)   that when his bus was checked again on 3.4.79 on way to<\/p>\n<p>            Bathinda from Mukatsar he was found to have charged Rs.2\/-<\/p>\n<p>            from four passeners (@ Rs.0.50 ps per head) without issuing<\/p>\n<p>            any tickets to them.&#8221;\n<\/p><\/blockquote>\n<p>Having found the appellant &#8211; workman guilty, he was terminated from his<\/p>\n<p>employment. Dis-satisfied with the determination rendered by the General<\/p>\n<p>Manager, Punjab Roadways, Mukatsar, the appellant raised a dispute, which<\/p>\n<p>was referred to the Presiding Officer, Labour Court, Bathinda. The<\/p>\n<p>Presiding Officer, Labour Court, Bathinda, vide an award dated 25.03.1987<\/p>\n<p>declined the claim of the appellant. The finding, recorded by the General<\/p>\n<p>Manager, Punjab Roadways, Mukatsar, was upheld.\n<\/p>\n<p>            Dis-satisfied with the award of the Presiding Officer, Labour<\/p>\n<p>Court, Bathinda, dated 25.03.1987, the appellant approached this Court by<\/p>\n<p>filing Civil Writ Petition No. 10218 of 1988. The learned Single Judge<\/p>\n<p>dismissed the aforesaid writ petition on 17.11.2008. The instant Letters<\/p>\n<p>Patent Appeal has been filed to assail the order passed by this Court on<\/p>\n<p>17.11.2008, whereby Civil Writ Petition No. 10218 of 1988 preferred by the<\/p>\n<p>appellant was dismissed.\n<\/p>\n<p>            During the course of hearing, learned counsel for the appellant<\/p>\n<p>has advanced only one contention, namely, that during the course of the<\/p>\n<p>departmental enquiry, the proceedings before the Presiding Officer, Labour<\/p>\n<p>Court, Bathinda, as also before this Court during the course of the<\/p>\n<p>determination of the Civil Writ Petition No. 10218 of 1988, the evidence<\/p>\n<p>produced at the hands of the appellant was not appropriately assessed.<br \/>\n<span class=\"hidden_text\"> LPA No. 241 of 2009                                                         3<\/span><\/p>\n<p>                It is not possible for us to accept the aforestated contention<\/p>\n<p>advanced by the learned counsel for the appellant. The conclusion drawn by<\/p>\n<p>the authorities referred to hereinabove is well reasoned and calls for no<\/p>\n<p>interference.\n<\/p>\n<p>                Despite the conclusion recorded by us in the foregoing<\/p>\n<p>paragraph, we consider it just and appropriate to extract hereunder the basis<\/p>\n<p>of the claim on which the appellant suggests that the consideration at the<\/p>\n<p>hands of the authorities was inappropriate. We are accordingly extracting<\/p>\n<p>hereunder the part of the statement of Harminder Singh, (one of the<\/p>\n<p>witnesses produced by the appellant, during the course of the departmental<\/p>\n<p>proceedings) to which the learned counsel for the appellant had invited our<\/p>\n<p>attention, during the course of hearing:-\n<\/p>\n<blockquote><p>                &#8220;On 17.6.79, there were two other passengers with me. We had<\/p>\n<p>                boarded the Punjab Roadways Bus at 5.15 a.m. from Mukatsar<\/p>\n<p>                for Sirsa. When the bus reached Malout, it was checked by an<\/p>\n<p>                Inspector. On enquiry from him whether we had to go to Sirsa<\/p>\n<p>                or Delhi, we replied that we have to go to Delhi, but from Sirsa<\/p>\n<p>                some of our passengers were to board the bus. We have to go to<\/p>\n<p>                Delhi after waiting for them. Despite our saying so the<\/p>\n<p>                Inspector forcibly took the unpunched tickets from Sirsa to<\/p>\n<p>                Delhi from the conductor. We had tickets from Mukatsar to<\/p>\n<p>                Sirsa.&#8221;\n<\/p><\/blockquote>\n<p>Having perused the statement recorded by one of the defence witnesses of<\/p>\n<p>the appellant, we are satisfied that the same is, in fact, a turn around of their<\/p>\n<p>earlier account, inasmuch as they clearly informed the Inspector who had<\/p>\n<p>checked the bus that they had boarded the bus to go to Delhi, although they<br \/>\n<span class=\"hidden_text\"> LPA No. 241 of 2009                                                          4<\/span><\/p>\n<p>tried to mix-up the factual position by asserting that, some other passengers<\/p>\n<p>were to accompany them from Sirsa for their onwards journey to Delhi.<\/p>\n<p>Having recorded our remarks as above, we are satisfied that the statement of<\/p>\n<p>the defence witness, relied upon by the learned counsel for the appellant,<\/p>\n<p>cannot be read to draw an inference in his favour.\n<\/p>\n<p>             For the reasons recorded hereinabove, we find no merit in the<\/p>\n<p>instant appeal and the same is accordingly dismissed.<\/p>\n<p>             In view of the fact that the main appeal has been dismissed on<\/p>\n<p>merits, we find no justification for passing a separate order on the<\/p>\n<p>application for condoning the delay (in filing the instant appeal).<\/p>\n<pre>\n\n\n\n                                                           ( J.S.
