Notwithstanding the aforesaid direction issued by this<br \/>\n\tCourt way back in 2007, Registry has not arranged to get the<br \/>\n\tpaper-book prepared from the concerned Sessions Court. He,<br \/>\n\ttherefore, again urges that since the applicant is in jail since<br \/>\n\tlast more than 4 years, necessary direction be issued to prepare the<br \/>\n\tpaper-book at the earliest and, thereafter, this matter may be<br \/>\n\tlisted for final hearing.\n<\/p>\n<p>Having<br \/>\n\theard Mr.R.M.Agrawal, learned advocate for the applicants and<br \/>\n\tMr.L.B.Dabhi, learned APP for the respondent &#8211; State of<br \/>\n\tGujarat and on perusal of the averments made in the application as<br \/>\n\twell as the order dated 21.11.2007 rendered in Criminal<br \/>\n\tMisc.Application No.11608 of 2007 in above-numbered criminal appeal,<br \/>\n\tit shocks our conscious that though the order was passed way back in<br \/>\n\t2007 and till today Registry is not able to get the paper-book<br \/>\n\tprepared from the concerned Sessions Court, we are not sure as to<br \/>\n\twhether the Registry has communicated this order to the concerned<br \/>\n\tSessions Court, and if it is not communicated, then it is a serious<br \/>\n\tlapse on the part of the Registry, and if it is communicated to the<br \/>\n\tconcerned Sessions Court and the Sessions Court has not prepared the<br \/>\n\tpaper-book, then it is a serious lapse on the part of the concerned<br \/>\n\tSessions Court.\n<\/p>\n<p>We,<br \/>\n\ttherefore, hereof direct the Registry to call upon an explanation as<br \/>\n\tto why this lapse has occurred and who is at fault on or before<br \/>\n\t01.09.2010.\n<\/p>\n<p>Meanwhile,<br \/>\n\tRegistry is further directed to get the paper-book prepared from the<br \/>\n\tconcerned Sessions Court within a period of 7 days hereof, and on<br \/>\n\treceipt of the paper-book, Registry is further directed to list the<br \/>\n\tabove-numbered criminal appeal on the cause-list for final hearing,<br \/>\n\tforthwith.
