SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/03\/2011 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Articles 226 and 227 of the Constitution<br \/>\nof India, the petitioners, who are alleged to be claiming the right<br \/>\non the land in question on the basis of Will dated 17\/03\/1988<br \/>\nexecuted by original land owner &#8211; Shantaben Kunvarjibhai Patel, for<br \/>\nan appropriate writ, order and\/or direction, quashing and setting<br \/>\naside the order dated 09\/04\/1989 passed by Mamlatdar, Choryashi by<br \/>\ncancelling mutation entry No.2001; the order dated 10\/12\/1991 passed<br \/>\nby Deputy Collector, Choryashi in Remand Case No.57\/1991; the order<br \/>\ndated 26\/02\/1993 passed by Collector, Surat in RTS Revision<br \/>\nApplication No.118\/1992 as well as impugned order dated 01\/04\/1999<br \/>\npassed by learned Additional Chief Secretary (Appeals), Revenue<br \/>\nDepartment, State of Gujarat in Revision Application No.40\/1993.\n<\/p>\n<p>2.\t\tHaving<br \/>\nheard Mr.Rajesh Shah, learned advocate appearing on behalf of the<br \/>\npetitioners and Mr.Pranav Dave, learned Assistant Government Pleader<br \/>\nappearing on behalf of the respondent and considering the impugned<br \/>\norders, it appears that the dispute is with respect to mutation entry<br \/>\nNo.2001. The respective petitioners tried to mutate their names on<br \/>\nthe basis of the Will executed by original land owner &#8211; Shantaben<br \/>\nKuvanji Patel. However, considering the fact that respective<br \/>\npetitioners could not produce on record any documents to show that at<br \/>\nthe relevant time when the Will was executed, they were agriculturist<br \/>\nand even otherwise considering the fact that transfer by Will is not<br \/>\npermissible, the Mamlatdar, Choryashi passed an order to cancel the<br \/>\naforesaid mutation entry No.2001, which came to be confirmed by<br \/>\nDeputy Collector, Choryashi vide order dated 10\/12\/1991, which<br \/>\nfurther came to be confirmed by the Collector, Surat vide order dated<br \/>\n26\/02\/1993 as well as order dated 01\/04\/1999 passed by Additional<br \/>\nChief Secretary (Appeals), Revenue Department, State of Gujarat in<br \/>\nRevision Application No.40\/1993.\n<\/p>\n<p>3.\t\tApart<br \/>\nfrom the fact that there are concurrent findings of facts given by<br \/>\nall authorities below, as the dispute is with respect to mutation<br \/>\nentry as well as considering the decision of Division Bench of this<br \/>\nCourt in the case of Rajenbhai Baldevbhai Shah V\/s. Baijiben<br \/>\nKabhaibhai Patanvadia &amp; Ors. reported in 2009(2) GLR 1784,<br \/>\nit cannot be said that all the authorities below have committed an<br \/>\nerror in cancelling the aforesaid mutation entry. No illegality has<br \/>\nbeen committed by the Mamlatdar, Choryashi in cancelling the<br \/>\naforesaid mutation entry. Even otherwise, it also appears that the<br \/>\nland in question was tried to be bequeathed \/ transferred under the<br \/>\nguise of Will in favour of the petitioners. So far as respondent No.2<br \/>\nis concerned, who is from Village:Nalwa, Taluka: Nandarbar, District:<br \/>\nMaharashtra, it appears that an attempt was made by petitioner No.2<br \/>\nto purchase agricultural land in the State of Gujarat in breach of<br \/>\nprovisions of the Bombay Tenancy &amp; Agricultural Lands Act.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of the above, there is no substance in the present petition,<br \/>\nwhich deserves to be dismissed and is accordingly dismissed. Rule is<br \/>\ndischarged. Ad-interim relief granted earlier, if any, stands vacated<br \/>\nforthwith.
