Justice K.HEMA\n\n Dated :14\/06\/2010\n\n O R D E R\n                                K.HEMA, J\n                           -----------------------\n                       B.A No.2230 OF 2010\n                       --------------------------------\n               Dated this the 14th day of June 2010\n\n                                  ORDER\n<\/pre>\n<p>     This petition is for anticipatory bail.\n<\/p>\n<p>     2. The alleged offences are under Sections 420, 325, 352<\/p>\n<p>and 405 of IPC. According to prosecution, petitioner made false<\/p>\n<p>representation to de facto complainant who is an Italian born<\/p>\n<p>American citizen that property will be purchased and she will be<\/p>\n<p>allowed to reside in the building to be constructed, on lease etc.<\/p>\n<p>and she was made to part with a huge amount of rupees, about<\/p>\n<p>one crore in total, on different dates to petitioner. Property was<\/p>\n<p>purchased in the name of petitioner and buildings were<\/p>\n<p>constructed and a lease agreement was also executed.          But,<\/p>\n<p>thereafter, petitioner is trying to evict de facto complainant and<\/p>\n<p>send her out of the property. De facto complainant was cheated<\/p>\n<p>by petitioner and he also misappropriated money and ill-treated<\/p>\n<p>her by physically manhandling her. They were living as husband<\/p>\n<p>and wife.\n<\/p>\n<p>     3.    Learned counsel for petitioner submitted that the<\/p>\n<p>allegations are false.      Petitioner had only allowed de facto<\/p>\n<p>complainant to reside in a building constructed in his property<\/p>\n<p>and a lease agreement was executed for a period of 99 years at<\/p>\n<p><span class=\"hidden_text\">B.A No.2230 OF 2010             2<\/span><\/p>\n<p>the rate of Re.1\/- per month as rent.      But, de facto complainant<\/p>\n<p>started creating problems to petitioner by consuming liquor along<\/p>\n<p>with his workers in the restaurant and when he objected to this, she<\/p>\n<p>started behaving badly to petitioner.           Thereafter, de facto<\/p>\n<p>complainant gave a false complaint to the police.<\/p>\n<p>4. This petition is opposed by the learned Public Prosecutor        and<\/p>\n<p>learned counsel for the de facto complainant.       It is submitted by<\/p>\n<p>learned counsel for de facto complainant that the parties were living<\/p>\n<p>as husband and wife and an order was obtained by de facto<\/p>\n<p>complainant from the Magistrate Court injuncting petitioner from<\/p>\n<p>alienating the schedule property and interfering with the peaceful<\/p>\n<p>residence of de facto complainant and also from committing any act<\/p>\n<p>of domestic violence.      He had physically assaulted de facto<\/p>\n<p>complainant and disconnected the electricity connection to the<\/p>\n<p>building in which de facto complainant was residing and she had to<\/p>\n<p>run in darkness and she hit against the window glass and she was<\/p>\n<p>injured. It is also understood that petitioner is in the habit of taking<\/p>\n<p>money     from    other foreign  nationals   also   by   making    false<\/p>\n<p>representations and cheat them.\n<\/p>\n<p><span class=\"hidden_text\">B.A No.2230 OF 2010              3<\/span><\/p>\n<p>      5. Learned Public Prosecutor also submitted that the Case Diary<\/p>\n<p>reveals serious allegations against the petitioner.<\/p>\n<p>      6.
