      The petitioner is working as an Assistant Manager in the<\/p>\n
first respondent Corporation.    According to him he is qualified<\/p>\n
and eligible to be considered for promotion to the post of<\/p>\n
Regional Manager. In terms of the special rules applicable to<\/p>\n
the first respondent, the post of Regional Manager is to be<\/p>\n
filled up in the following manner:\n<\/p>\n<\/p>\n
      “Regional Manager a)       By promotion from Deputy<\/p>\n
                                 Manager\/Assistant Manager\/<\/p>\n
                                 Assistant Manager (Accounts)<\/p>\n
                                 or<\/p>\n<\/blockquote>\n
                           b)    Direct recruitment or<\/p>\n<\/blockquote>\n
                           c)    By deputation from State<\/p>\n
                                 Government service”.<\/p>\n<\/blockquote>\n
Therefore, one of the methods of appointment to the post of<\/p>\n
Regional     Manager     is  by    promotion    from   Assistant<\/p>\n
Manager\/Assistant Manager (Accounts) in the Corporation.<\/p>\n
W.P(C) NO.11380 OF 2008<\/p>\n
                              -: 2 :-<\/span><\/p>\n
Petitioner points out that one of the qualifications prescribed<\/p>\n
for promotion to the post of Regional Manager in the case of<\/p>\n
Assistant Manager is 7 years’ experience.       Petitioner was<\/p>\n
appointed as an Assistant Manager in the year        2000 and<\/p>\n
acquired the eligibility for being considered for promotion to<\/p>\n
the post of Regional Manager on 3.11.2007. He submits that<\/p>\n
there are currently 4 sanctioned posts of Regional Manager in<\/p>\n
the Corporation in Kollam, Ernakulam, Kozhikode and Kannur.<\/p>\n
On the premise that there are no qualified Assistant<\/p>\n
Managers, to be considered for promotion to the post of<\/p>\n
Regional Manager, currently all the 4 Regional Managers in the<\/p>\n
Corporation are persons appointed         on deputation from<\/p>\n
outside. Petitioner submits that since he has acquired 7 years’<\/p>\n
experience as Assistant Manager, he is entitled to be<\/p>\n
considered for promotion to the post of Regional Manager in<\/p>\n
terms of the special rules.\n<\/p>\n
     2.    A statement has been filed by the first respondent.<\/p>\n
Reference is made to Exhibit R1(a) decision taken by the Board<\/p>\n
of Directors of the first respondent. It is contended that the<\/p>\n
Board has taken a decision to abolish the post of Regional<\/p>\n

Manager and it will be re-designated as District Manager.<\/p>\n
Both these require amendment of the special rules. In the<\/p>\n
circumstances, approval of the Government has been sought<\/p>\n
for in relation to Exhibit R1(a) decision.       Government’s<\/p>\n
approval has not been obtained.       Exhibit R1(b) to which<\/p>\n
reference is made in this regard is pending consideration<\/p>\n
before the Government. Petitioner has filed a reply affidavit<\/p>\n
reiterating his contentions.\n<\/p>\n
     3.    What is contemplated even under Exhibit R1(a) is<\/p>\n
not abolition of the post of Regional Manager, but a re-naming<\/p>\n
of the post of Regional Manager as District Manager.<\/p>\n
     4.    I heard learned counsel for the petitioner, Shri<\/p>\n
P.C.Sasidharan, learned counsel for the first respondent<\/p>\n
Corporation, Shri Manilal and learned Special Government<\/p>\n
Pleader, Shri Santhosh Kumar.\n<\/p>\n
     5.    The stand taken by the first respondent that the<\/p>\n
petitioner’s claim for being considered to the post of Regional<\/p>\n
Manager cannot be considered on the premise that there is a<\/p>\n
proposal to re-name the post of Regional Manager to that of<\/p>\n
District Manager or even abolition of the post of Regional<\/p>\n

                             -: 4 :-<\/span><\/p>\n
Manager is not sustainable. Admittedly, the decision taken<\/p>\n
by the first respondent in that regard either to abolish the<\/p>\n
post of Regional Manager or re-name the same to that of<\/p>\n
District Manager requires the approval of the Government. It<\/p>\n
also necessitates amendment of the special rules which again<\/p>\n
requires the approval of the Government. Again it is not the<\/p>\n
case of the first respondent that there is no Regional Manager<\/p>\n
in the first respondent Corporation currently functioning in<\/p>\n
such capacity from the date of Exhibit R1(a). The case of the<\/p>\n
petitioner that there are currently 4 Regional Managers who<\/p>\n
are working on deputation from outside is not controverted.<\/p>\n
If that be so,    there are vacancies in the post of Regional<\/p>\n
Manager currently available and if the petitioner is qualified in<\/p>\n
terms of the special rules he is entitled to be considered for<\/p>\n
being posted to the said post.\n<\/p>\n
     In the result, the Writ Petition is disposed of directing<\/p>\n
the first respondent to consider the case of the petitioner for<\/p>\n
promotion to the post of Regional Manager, in accordance with<\/p>\n
the special rules for the Kerala State Backward Classes<\/p>\n
Development Corporation.      Orders in this regard shall be<\/p>\n
W.P(C) NO.11380 OF 2008<\/p>\n

passed within a period of four weeks from the date of receipt<\/p>\n
