    This  appeal    is   preferred    against  the<\/p>\n
judgment and decree passed by the Subordinate<\/p>\n
Judge, Thodupuzha in O.S.110\/82.      The suit is<\/p>\n
one for recovery of possession on the strength<\/p>\n
of title with arrears of rent and damages.<\/p>\n
According to the plaintiffs,       first plaintiff<\/p>\n
has obtained a lease over items 1 to 4 for<\/p>\n
cardamom cultivation from the department. Item<\/p>\n
No.5 was obtained by the 2nd plaintiff under a<\/p>\n
partition in her family.     It is submitted that<\/p>\n
on 5.3.70 plaintiffs executed and registered a<\/p>\n
‘kuthakapathram’ in favour of the defendant for<\/p>\n
a period of nine years on payment of rent of<\/p>\n

Rs.3,000\/- per year.        Now it is over that<\/p>\n
property the plaintiffs are claiming recovery of<\/p>\n
possession.     Originally  the   first  defendant<\/p>\n
contested     the  suit   and   now  the   present<\/p>\n
contesting defendants are intervenors.<\/p>\n
     2.    Heard  the  learned   counsel  for  the<\/p>\n
appellant as well as the respondent.      I feel a<\/p>\n
peculiar situation has arisen in this case with<\/p>\n
respect to item Nos.1 to 4 of the plaint<\/p>\n
schedule. According to plaintiffs, items 1 to 4<\/p>\n
were obtained by them under a lease agreement by<\/p>\n
the department.    It was found by the department<\/p>\n
correctly or incorrectly that there had been<\/p>\n
violation    of   the  terms   of  the  lease  and<\/p>\n
therefore they have terminated the lease in<\/p>\n
favour     of  the  first  plaintiff   and  it  is<\/p>\n
contended that the contesting defendants had<\/p>\n
been given the lease of the property.<\/p>\n

     3.    The learned counsel for the plaintiffs<\/p>\n
would    submit   that  in   a  previous round  of<\/p>\n
litigation this Court had found that it is not a<\/p>\n
lease but a licence and therefore there cannot<\/p>\n
be any violation of the terms of the contract of<\/p>\n
lease.     But rightly or wrongly the department<\/p>\n
moved    action   terminating   the lease of   the<\/p>\n
plaintiff and it is under challenge and pending<\/p>\n
before this Court in the writ jurisdiction as<\/p>\n
W.P.C. 17510\/05.     So the title of the plaintiff<\/p>\n
is now hanging.\n<\/p>\n
     4.    In a suit for recovery of possession<\/p>\n
also the Court has to take into consideration<\/p>\n
whether the plaintiff has got title to the<\/p>\n
property when a decree is granted in his favour.<\/p>\n
Unfortunately, the trial court has entered into<\/p>\n
a finding whether it is a lease or a licence<\/p>\n
depending upon the earlier ruling but without<\/p>\n

making the Government a party who had terminated<\/p>\n
the lease. It may be true that the said finding<\/p>\n
may have bearing on the issue but the decision<\/p>\n
cannot be rendered against a Department or a<\/p>\n
Government without impleading or getting it as a<\/p>\n
party.     So everything depends upon the outcome<\/p>\n
of the writ petition. Therefore it is desirable<\/p>\n
in this case as well that the department is also<\/p>\n
made a party and the matter can be pursued when<\/p>\n
the judgment of this Court comes in the writ<\/p>\n
petition.     So far as item 5 is concerned 2nd<\/p>\n
plaintiff has got title to the property under a<\/p>\n
partition deed of the year 1956. The contesting<\/p>\n
defendants are claiming right only by adverse<\/p>\n
possession.     The trial court has considered it<\/p>\n
and found that adverse possession is not proved<\/p>\n
at all.      When petitioner’s possession is not<\/p>\n
proved the 2nd plaintiff is entitled to that<\/p>\n

relief with respect to that item.       Further the<\/p>\n
Court below also verified the documents Exts.B15<\/p>\n
to   17,   19,   22  and 23    and  held  that  the<\/p>\n
defendants entitlement is not supported by those<\/p>\n
documents.\n<\/p>\n
     5.    The trial court has held that there is<\/p>\n
no evidence to show that the 2nd defendant had<\/p>\n
obtained    possession  of     plaint item   5  and<\/p>\n
perfected    title   by  adverse    possession  and<\/p>\n
limitation.      The Court held that “Apart from<\/p>\n
these tax receipts, which are very feeble pieces<\/p>\n
of material, nothing is available to prove the<\/p>\n
contention and found that no oral evidence has<\/p>\n
been adduced. So in the light of the fact that<\/p>\n
the 2nd plaintiff’s claim stand satisfied by the<\/p>\n
document of 1956 and in the absence of any<\/p>\n
document     on   the  side    of   the  contesting<\/p>\n
defendants, it has to be held that the plaintiff<\/p>\n

is entitled to recovery of possession of item<\/p>\n
No.5 of the plaint schedule property. Therefore<\/p>\n
the appeal is disposed of as follows.<\/p>\n
     (1) So far as it relates to items 1 to 4<\/p>\n
are concerned, judgment and decree of the trial<\/p>\n
Court are set aside and the matter is remanded.<\/p>\n
The plaintiffs are directed to implead the<\/p>\n
department    also  as  a   party  since  it has<\/p>\n
cancelled    the   lease in    their  favour and<\/p>\n
thereafter pursue the matter which would depend<\/p>\n
upon the fate of the writ petition pending<\/p>\n
before this Court.\n<\/p>\n
     (2) So far as item No.5 is concerned the<\/p>\n
finding of the trial court is confirmed and the<\/p>\n
plaintiffs are given a decree for recovery of<\/p>\n
possession of item No.5 of the property on the<\/p>\n
strength of title from the defendants.<\/p>\n

     (3) The Receiver be directed to hand over<\/p>\n
possession of the property to the plaintiffs and<\/p>\n
he can be discharged after submission of proper<\/p>\n
accounts. Parties are directed to appear before<\/p>\n
the trial Court with respect to item Nos.1 to 4<\/span><\/p>\n
on 10.11.2011.\n<\/p>\n<\/p>\n
