During<br \/>\n\tthe pendency of the said application under sec. 166 of the mV Act,<br \/>\n\t1988, the claimant filed an application under section 140 of the MV<br \/>\n\tAct, 1988 claiming Rs.25000.00 on the basis of No Fault Liability.<br \/>\n\tBefore the Claims Tribunal, FIR, panchanama of scene of offence,<br \/>\n\tinsurance particulars, RC Book, Injury certificate, case papers and<br \/>\n\tdisability certificate were produced by the claimant. Thereafter,<br \/>\n\tthe Claims Tribunal has decided the matter and came to the<br \/>\n\tconclusion that the claimant is entitled for the amount of<br \/>\n\tRs.25000.00 on the principle of No Fault Liability and the appellant<br \/>\n\tis directed to deposit the said amount before the Tribunal. On<br \/>\n\trealisation of the amount as aforesaid, a sum of Rs.12500.00 was<br \/>\n\tordered to be paid in cash by crossed account payee cheque to the<br \/>\n\tclaimant  and the remaining amount was ordered to be deposited in<br \/>\n\tthe name of of the claimant in fixed deposit receipt for a period of<br \/>\n\tthree years in any nationalizied bank with a liberty to withdraw<br \/>\n\tinterest monthly or periodically by the claimant with a further<br \/>\n\tdirection that the bank shall not allow any loan or advances against<br \/>\n\tthe aforesaid fixed deposit receipt without previous permission of<br \/>\n\tthe Tribunal.
