The present appeal arises out of the award dated 14.3.1991<\/p>\n<p>of the Motor Accident Claims Tribunal whereby the Tribunal<\/p>\n<p>awarded a sum of Rs. 1,56,400\/- along with interest @ 12% per<\/p>\n<p>annum to the claimants.\n<\/p>\n<p><span class=\"hidden_text\">FAO No. 149\/1991                                   Page 1 of 4<\/span>\n<\/p>\n<p> 2.    The brief conspectus of the facts is as follows:<\/p>\n<p>3.    On 16.6.1984 at about 10.00 AM, deceased Parveen Kumar<\/p>\n<p>Seth was riding his two wheeler scooter bearing registration No:<\/p>\n<p>DHV 8976 and was going to Modi Nagar.           He was driving the<\/p>\n<p>scooter on his left side when he was hit by bus bearing<\/p>\n<p>registration No: DHP 2914 which came from the side of<\/p>\n<p>Khicharipur border on the national highway, as a result of which<\/p>\n<p>the deceased fell down on the road and was crushed under the<\/p>\n<p>front wheel of the bus.      The deceased and his scooter were<\/p>\n<p>dragged upto a considerable distance as a consequence of which<\/p>\n<p>Parveen Kumar Seth died on the spot.\n<\/p>\n<\/p>\n<p>4.    A claim petition was filed on 13.7.1984 and an award was<\/p>\n<p>passed on     14.3.1991. Aggrieved with the said award DTC has<\/p>\n<p>filed the present appeal.\n<\/p>\n<\/p>\n<p>5.    Mr. J. N. Aggarwal, counsel for the appellant DTC contended<\/p>\n<p>that no appeal was filed by the respondents for enhancement and<\/p>\n<p>the entire compensation amount has been withdrawn by the<\/p>\n<p>claimants. The counsel urged that the respondent no. 1 is getting<\/p>\n<p><span class=\"hidden_text\">FAO No. 149\/1991                                         Page 2 of 4<\/span><br \/>\n pension of Rs. 420\/- from ESIC and as per Sections 53 and 61 of<\/p>\n<p>ESIC Act An insured person or his dependents are not entitled to<\/p>\n<p>any compensation under any other law in force when they are<\/p>\n<p>getting benefits under the ESIC Act.\n<\/p>\n<\/p>\n<p>6.    Nobody appeared for the respondents.\n<\/p>\n<\/p>\n<p>7.    I have heard counsel for the appellant and perused the<\/p>\n<p>record.\n<\/p>\n<\/p>\n<p>8.    Section 53 and 61 of the Employees&#8217; State Insurance Act,<\/p>\n<p>1948, read as under:\n<\/p>\n<blockquote><p>            &#8220;Bar against receiving or recovery of compensation<br \/>\n            or damages under any other law :- An insured person<br \/>\n            or his dependents shall not be entitled to receive or<br \/>\n            recover, whether from the employer of the insured<br \/>\n            person or from any other person, any compensation<br \/>\n            or damages under the Workmen&#8217;s compensation Act,<br \/>\n            1923 (8 of 1923), or any other law for the time being<br \/>\n            in force or otherwise, in respect of an employment<br \/>\n            injury sustained by the insured person as an<br \/>\n            employer under this Act.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>            61. Bar of benefits under other enactments<br \/>\n            When a person is entitled to any of the benefits<br \/>\n            provided by this Act, he shall not be entitled to<br \/>\n            receive any similar benefit admissible under the<br \/>\n            provisions of any other enactment.&#8221;<\/p><\/blockquote>\n<p>      Thus, it is obvious that for the application of section 53, two<\/p>\n<p>conditions are necessary, viz., (i) that the person must have<\/p>\n<p><span class=\"hidden_text\">FAO No. 149\/1991                                         Page 3 of 4<\/span><br \/>\n sustained employment injury and (ii) that he must have been<\/p>\n<p>insured under the Employees&#8217; State Insurance Act.<\/p>\n<p>9.      What is employment injury is defined under S. 2(8) of the<\/p>\n<p>Employees&#8217; State Insurance Act, 1948. It reads :<\/p>\n<blockquote><p>               &#8220;`employment injury&#8217; means a personal injury to an<br \/>\n               employee caused by accident or an occupational<br \/>\n               disease arising out of and in the course of his<br \/>\n               employment, being an insurable employment,<br \/>\n               whether the accident occurs or the occupational<br \/>\n               disease is contracted within or outside the territorial<br \/>\n               limits of India.&#8221;\n<\/p><\/blockquote>\n<p>10.       A motor accident, when the workman was going on a two<\/p>\n<p>wheeler scooter, cannot be considered as an employment injury.<\/p>\n<p>That being so, it is obvious that Ss. 53 &amp; 61 of the Employees&#8217;<\/p>\n<p>State Insurance Act, 1948, would not bar the remedy in this case<\/p>\n<p>under S. 110A of the Motor Vehicles Act, 1939.<\/p>\n<p>11.
