THE SECRETARY DEPARTMENT OF FINANCE BIHAR,PATNA\n                                 -----------\n<\/pre>\n<p>2.   12.8.2010                Heard learned counsel for the petitioner and<\/p>\n<p>                 the State.\n<\/p>\n<p>                              It is submitted that the petitioner and one<\/p>\n<p>                 Arun Kumar were initially appointed on the post of<\/p>\n<p>                 Electrician. They were regularized on 26.11.1981 in the<\/p>\n<p>                 pay scale of Rs. 180-242\/-.        From 31.12.1981, the<\/p>\n<p>                 Finance Department revised the pay scale of Electrician<\/p>\n<p>                 as Rs. 220-315\/-. Both the petitioner and Arun Kumar<\/p>\n<p>                 filed application in 1995 separately for the revised pay<\/p>\n<p>                 scale. It was allowed to Arun Kumar on 21.9.1995, while<\/p>\n<p>                 the petitioner&#8217;s application remains pending.<\/p>\n<p>                              Counsel for the State urges delay in the<\/p>\n<p>                 petitioner moving for relief.\n<\/p>\n<p>                              Issues   of   delay   are   irrelevant   where<\/p>\n<p>                 constitutional rights are concerned. If the petitioner has<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>           been subjected to hostile discrimination vis-\u00e0-vis Arun<\/p>\n<p>           Kumar similarly situated, it was the obligation of the<\/p>\n<p>           respondents to pay him the enhanced pay scale.<\/p>\n<p>                       It appears from the Letter No. 140 dated<\/p>\n<p>           26.9.2006 that the factual assertions of the petitioner<\/p>\n<p>           have been found to be prima facie correct by the<\/p>\n<p>           Executive   Engineer,   Building   Construction     Division,<\/p>\n<p>           Bettiah.\n<\/p>\n<p>                       Let the respondents consider the grievances of<\/p>\n<p>           the petitioner and dispose it off by a reasoned and<\/p>\n<p>           speaking order within a maximum period of four months<\/p>\n<p>           from the date of receipt\/production of a copy of this<\/p>\n<p>           order.\n<\/p>\n<p>                       It is expected that if the respondents find<\/p>\n<p>           justification in the claim or any part of the claim, they<\/p>\n<p>           shall pay him his legitimate dues within the aforesaid<\/p>\n<p>           period.\n<\/p>\n<p>                       The writ application stands disposed.<\/p>\n<pre>P.
