Justice R.BASANT\n\n Dated :11\/06\/2007\n\n O R D E R\n                               R.BASANT, J.\n\n                            ----------------------\n\n                         Crl.M.C.No.1876 of 2007\n\n                        ----------------------------------------\n\n                 Dated this the  11th day of June 2007\n\n\n\n\n                                   O R D E R\n<\/pre>\n<p>      The   petitioner   faces   indictment   in   a   prosecution   under<\/p>\n<p>Section   8   of   the   Kerala   Abkari   Act.     The   petitioner   has   not<\/p>\n<p>entered appearance so far.   He finds a warrant of arrest issued<\/p>\n<p>by the learned Magistrate chasing him.  The petitioner is willing<\/p>\n<p>to   appear   before   the   learned   Magistrate.     But   he   apprehends<\/p>\n<p>that the learned Magistrate may not consider his application for<\/p>\n<p>bail   on   merits,   in   accordance   with   law   and   expeditiously.     He<\/p>\n<p>may   not   be   granted   bail   by   the   learned   Magistrate,   it   is<\/p>\n<p>apprehended.     In   these   circumstances,   it   is   prayed   that<\/p>\n<p>directions   may   be   issued   under   Section   482   Cr.P.C   to   the<\/p>\n<p>learned   Magistrate   to   release   the   petitioner   on   bail   when   he<\/p>\n<p>appears or is produced before the learned Magistrate.\n<\/p>\n<p>      2.     It   is   for   the   petitioner   to   appear   before   the   learned<\/p>\n<p>Magistrate   and   explain   to   the   learned   Magistrate,   the<\/p>\n<p>circumstances   under   which   he   could   not   earlier   appear   before<\/p>\n<p>the learned Magistrate.     I find absolutely  no reason  to assume<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.1876\/07                    2<\/span><\/p>\n<p>that   the   learned   Magistrate   would   not   consider   the   application<\/p>\n<p>for bail to be filed by the petitioner on merits, in accordance with<\/p>\n<p>law and expeditiously. Every court must do the same. No special<\/p>\n<p>or specific directions appear to be necessary. Sufficient general<\/p>\n<p>directions   have   been   issued   in         Alice   George   vs.Deputy<\/p>\n<p>Superintendent of Police [2003(1)KLT 339].\n<\/p>\n<p>       3.
