4. Brief facts of the case are:\n<\/p>\n
‘That on 28.01.2007 when deceased Durgappa
\nwas proceeding on bicycle from Murugeshapalya<\/p>\n
towards Nagavara Palya near Geethanjali  a<\/p>\n
BMTC bus bearing registration No. KA <\/p>\n
from behind in a rash andyn’eglige5nt _fnat4iner_jg.a1?1.dl’<\/p>\n
dashed him, as a result, he sustaineld grieyous, <\/p>\n
and died on the spot. Hencelyhtis  and  filed a’<\/p>\n
claim petition before  seeking
\ncompensation of  Tribunal has
\nawarded cc~1r:};\u00a7ensation  — with interest<\/p>\n
at 6%  <\/p>\n
5.   regarding death of deceased
\nDurgaplpallin  negligence and liability of the<\/p>\n
I_11l3urc1* of .lt’lie….Qff.\u00a2nding vehicle the only point that<\/p>\n
‘  lrcmainsifor’consideration is:<\/p>\n
A j_ l.’?Whether the compensation awarded by
\nthe.-Tribunal is just and reasonable or does it
\n~. call for enhancement?\n<\/p>\n
it  After hearing the learned Counsel appearing for<\/p>\n
 the parties and perusing the judgment and award of the<\/p>\n
Tribunal I am of the Vi\u20acW that the compensation<\/p>\n
EV<\/p>\n
awarded by the Tribunal is not just and reasonable, it
\nis on the lower side and therefore it is deservedto be<\/p>\n
enhanced. * V  h<\/p>\n
7. Deceased Durgappa was aged about;25\u00abiyeal5s_1’at<\/p>\n
the time of his death in the accidentas from,’ <\/p>\n
post mortem report Ex. P 6.1_c1a.a\ufb01;a\ufb01r.s”w1ao\u00bbaz:_\u00e9<\/p>\n
mother and wife of the-.___ deceased iull’ <\/p>\n
their contention that  earning
\nRs.6,000\/– pm. by’  exarnining first
\nclaimant as  1  any document
\nregarding _i    l  onsidering year of
\naccident,’  and his profession as
\ncoolie ltiile  deceased assessed by the<\/p>\n
 at.’ ‘R~s,3_,_Q00\/– p.rn. and deduction of 1\/31″<\/p>\n
‘ Utowardslhis”p_ersona1 expenses is just and proper. But<\/p>\n
o5’ful18 is applicable as against 17 applied by<\/p>\n
the ribnlnal. Accordingly loss of dependency Works<\/p>\n
   to Rs.4.32.0o0\/~ {Rs.3,000\/– x 2\/3 x 12 x 18) and<\/p>\n
digit is awarded as against Rs.4,08,000\/~\u00ab awarded by the<\/p>\n
Tribunal.\n<\/p>\n<\/p>\n
8. The Tribunal has rightly awarded Rs.60,000\/–
\ntowards conventional heads such loss of consortium,<\/p>\n
loss of love and affection, loss of estate, transp.ortat;ion<\/p>\n
of dead body and funeral expenses  *11o<\/p>\n
scope for enhancernent under con.Veentic~na’1″he-ads.V”.V  <\/p>\n
9. Accordingly the appeal  <\/p>\n
judgment and award of thleV:V”‘Fr_ibun’al_’ to there’<\/p>\n
extend stated hereinahoveV,t.——–‘i’bhe ‘c1gun}ia’m.s.. entitled
\nfor a total — as against
\nRs.4,68,000.\/.-~laivardeldyhe  ‘with interest at
\nQ% p.a.   of Rs.24,000\/\\
\n[Ru1:lVees–.T’Aur.edrli only) from the date of
\nclaim Iaetition   realisation.\n<\/p>\n
  uIns:1jI*an_c_e,Con1pany is directed to deposit the<\/p>\n
‘,.e11hanced~_’compensation with interest within two<\/p>\n
 the date of receipt of a copy of this<\/p>\n
 judgrnent:. Out of the same Rs.l5,()OO\/– with<\/p>\n
 .}V3i3o_1_3ortionate interest is ordered to be invested in the<\/p>\n
Vl\u00e9riame of the second claimant who is the wife of the<\/p>\n
deceased for a period of seven years and the remaining<\/p>\n
