Justice R.BASANT\n\n Dated :26\/11\/2007\n\n O R D E R\n                                R.BASANT, J\n                        ------------------------------------\n                        Crl.M.C.No.3544 of 2007\n                        -------------------------------------\n              Dated this the 26th day of November, 2007\n\n                                  O R D E R\n<\/pre>\n<p>      Petitioners face indictment in a prosecution for offences<\/p>\n<p>punishable, inter alia, under Section 326 I.P.C. The petitioners were<\/p>\n<p>not available for trial. The co-accused who faced trial were found not<\/p>\n<p>guilty and acquitted by the trial court. Case against the petitioners<\/p>\n<p>has been split up. Coercive processes have been issued against the<\/p>\n<p>petitioners by the learned Magistrate.\n<\/p>\n<p>      2.    The petitioners have come to this Court with a prayer that<\/p>\n<p>powers under Section 482 Cr.P.C may be invoked to quash the<\/p>\n<p>proceedings against the petitioners.            What are the reasons ? The<\/p>\n<p>learned counsel for the petitioners contends that in the trial against<\/p>\n<p>the co-accused certain findings have been entered into, which must<\/p>\n<p>reveal to the court that further prosecution in this case would be<\/p>\n<p>unnecessary and a sheer waste of time. In as much as there is no<\/p>\n<p>possibility of anything productive coming out of this prosecution now,<\/p>\n<p>the further proceedings may be quashed by invoking the powers under<\/p>\n<p>Section 482 Cr.P.C, submits the learned counsel for the petitioners.<\/p>\n<p>      3.    The decision in [<a href=\"\/doc\/217622\/\">Moosa v. Sub Inspector of Police<\/a> [2006<\/p>\n<p>(1) KLT 552 (F.B)] makes the position crystal clear. The hostility of<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3544 of 2007            2<\/span><\/p>\n<p>some of the witnesses and the consequent acquittal of the co-accused<\/p>\n<p>who faced trial are no reason for an absconding co-accused to claim<\/p>\n<p>any benefit or advantage. The petitioners must surrender before the<\/p>\n<p>learned Magistrate and take part in the proceedings. If they are so<\/p>\n<p>entitled, they can certainly claim discharge under Section 239 Cr.P.C.<\/p>\n<p>I am not persuaded to agree that there is any merit or justification in<\/p>\n<p>the prayer for invocation of the extraordinary inherent jurisdiction<\/p>\n<p>under Section 482 Cr.P.C.\n<\/p>\n<p>      4.    The learned counsel for the petitioners submits that<\/p>\n<p>warrants of arrest are pending against the petitioners. The petitioners<\/p>\n<p>are willing to surrender before the learned Magistrate and seek<\/p>\n<p>regular bail. But they apprehend that their application for regular bail<\/p>\n<p>may not be considered by the learned Magistrate on merits, in<\/p>\n<p>accordance with law and expeditiously.     It is therefore prayed that<\/p>\n<p>directions under Section 482 Cr.P.C may be issued in favour of the<\/p>\n<p>petitioners.\n<\/p>\n<p>      5.    It is for the petitioners to appear before the learned<\/p>\n<p>Magistrate and explain to the learned Magistrate the circumstances<\/p>\n<p>under which they could not earlier appear before the learned<\/p>\n<p>Magistrate. I have no reason to assume that the learned Magistrate<\/p>\n<p>would not consider such application on merits, in accordance with law<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3544 of 2007             3<\/span><\/p>\n<p>and expeditiously.   Every court must do the same.         No special or<\/p>\n<p>specific direction appears to be necessary.          Sufficient general<\/p>\n<p>directions have already been issued in <a href=\"\/doc\/147290035\/\">Alice George v. The Deputy<\/p>\n<p>Superintendent of Police<\/a> [2003(1) KLT 339].\n<\/p>\n<p>      6.
