Justice M.SASIDHARAN NAMBIAR\n\n Dated :22\/01\/2010\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n          ===========================\n          CRL.M.C.No. 170,175 &amp;176\n                   OF 2010\n          ===========================\n\n    Dated this the 22nd day of January,2010\n\n                     ORDER\n<\/pre>\n<p>    Petitioner  is   the   second   accused  in<\/p>\n<p>C.C.865\/2008, 549\/2009 &amp; 1563\/2008 on the file<\/p>\n<p>of Judicial First Class Magistrate Court, Adoor<\/p>\n<p>taken  cognizance   for   the   offences  under<\/p>\n<p>sections 20,21 and 23 of Kerala Protection of<\/p>\n<p>River Banks and Regulation of Removal of Sand<\/p>\n<p>Act,2001(hereinafter referred to as the Act) on<\/p>\n<p>Annexure A1 final report submitted by the Sub<\/p>\n<p>Inspector    of    Police,    Pandalam    after<\/p>\n<p>investigation.    Petitions   are  filed  under<\/p>\n<p>section 482 of the Code of Criminal Procedure<\/p>\n<p>to  quash   the   cognizance   taken  and   the<\/p>\n<p>proceedings  pending   before   the  Magistrate<\/p>\n<p>contending that as provided under section 25 of<\/p>\n<p>the Act, cognizance can be taken only on a<\/p>\n<p>Crl.M.C.170,175 &amp; 176 of 2010      2<\/p>\n<p>complaint filed by the authorised officer and as<\/p>\n<p>cognizance has been taken by the learned Magistrate<\/p>\n<p>on the       final report submitted after investigation<\/p>\n<p>under section 173(2) of Code of Criminal Procedure,<\/p>\n<p>the cognizance taken is to be quashed.<\/p>\n<p>      2.          Learned      counsel appearing  for   the<\/p>\n<p>petitioner and the learned Public Prosecutor were<\/p>\n<p>heard.\n<\/p>\n<p>      3.      Section 25 of the Act provides that a<\/p>\n<p>cognizance of the offence under the Act can be<\/p>\n<p>taken only on a complaint filed by an officer<\/p>\n<p>authorised as provided under the Act.           Even if the<\/p>\n<p>Sub Inspector of Police is an authorised officer,<\/p>\n<p>he can only file a complaint based on which alone<\/p>\n<p>Magistrate can take cognizance of the offence under<\/p>\n<p>the Act.         As held by the Division Bench of this<\/p>\n<p>Court in <a href=\"\/doc\/272915\/\">Moosakoya v. State of Kerala<\/a> (2008(1) KLT<\/p>\n<p>538) as approved by the Apex Court in Jeewankumar<\/p>\n<p>Raut v. Central Bureau of Investigation (AIR 2009<\/p>\n<p>SC     2763)       and       followed by  this   court   in<\/p>\n<p>Crl.M.C.170,175 &amp; 176 of 2010      3<\/p>\n<p>Crl.M.C.3606\/2009 &amp; 3715\/2009, the cognizance taken<\/p>\n<p>can only be quashed.\n<\/p>\n<p>      Petitions           are    allowed.       C.C.865\/2008,<\/p>\n<p>C.C.549\/2009          &amp;     C.C.1563\/2008 on   the  file   of<\/p>\n<p>Judicial       Magistrate       of  First Class,  Adoor   are<\/p>\n<p>quashed.
