Justice V.RAMKUMAR\n\n Dated :20\/07\/2010\n\n O R D E R\n                       V.RAMKUMAR, J.\n                  ---------------------------------\n                 Crl.M.C.No.1956 of 2009\n                 ----------------------------------\n             Dated this the 20th day of July, 2010\n\n                             ORDER\n<\/pre>\n<p>     Petitioner, who is the second accused in Crime<\/p>\n<p>No.359\/2006 of Pathanamthitta Police Station for offences<\/p>\n<p>punishable under Sections 420, 465, 468 &amp; 471 read with<\/p>\n<p>Section 34 of I.P.C. and Sec.38 &amp; 39 of Travancore Cochin<\/p>\n<p>Medical Practitioners Act and Sec.15(2)(3) of the Indian<\/p>\n<p>Medical Council Act, seeks to quash Annexure A5 final<\/p>\n<p>report and further proceedings in C.C.No.108 of 2008 on<\/p>\n<p>the file of the Chief Judicial Magistrate, Pathanamthitta.<\/p>\n<p>     2.    It is too early for this Court exercising<\/p>\n<p>jurisdiction under Section 482 Cr.P.C to meticulously scan<\/p>\n<p>the voluminous prosecution records and to hold that the<\/p>\n<p>prosecution of the petitioner is groundless and the same is<\/p>\n<p>liable to be quashed. The appropriate remedy of the<\/p>\n<p>petitioner is to plead for a discharge before the Court<\/p>\n<p>below.\n<\/p>\n<p>     3. Having regard to the facts and circumstances of<\/p>\n<p>Crl.M.C.No.1956\/2009<br \/>\n<span class=\"hidden_text\">                             : 2 :<\/span><\/p>\n<p>the case, I am inclined to permit the petitioner to plead for<\/p>\n<p>a discharge in absentia. Accordingly if the petitioner files<\/p>\n<p>an application for discharge before the court below<\/p>\n<p>through her counsel, that court shall not insist on the<\/p>\n<p>personal appearance of the petitioner for the disposal of<\/p>\n<p>the discharge petition.
