S.J. MUKHOPADHAYA)<\/p>\n<p>  The<br \/>\nappellants, original respondents no. 1 &amp; 2 to the writ<br \/>\npetition,  were the original plaintiffs, have preferred this  Appeal<br \/>\nagainst the Order dated 7th<br \/>\nApril 2010 passed by the learned Single Judge, whereby, the<br \/>\nproceedings in  Regular Civil Suit No. 1491\/1993 preferred by the<br \/>\nappellants has been stayed.\n<\/p>\n<p>1.1<br \/>\n  Inspite<br \/>\nof service of notice, the respondents have not appeared and not<br \/>\ndisputed the facts as pleaded.\n<\/p>\n<p>2.<br \/>\n The<br \/>\nappellants-original plaintiffs filed Application Exh.157<br \/>\nfor impleading two persons as proposed defendants no. 5 &amp; 6 to<br \/>\nthe Suit. It was pleaded that the suit land, during pendency of the<br \/>\nsuit, had been transferred in favour of the proposed defendants no. 5<br \/>\n&amp; 6. Therefore, they were proper party and were required to be<br \/>\nimpleaded as party defendants to the suit. The same having allowed,<br \/>\nthe other defendants preferred writ<br \/>\npetition wherein the impugned<br \/>\norder of stay of the suit proceeding has been passed.\n<\/p>\n<p>3.<br \/>\n    Learned<br \/>\ncounsel for the appellants would submit that already 17 years have<br \/>\nlapsed and taking advantage of delay, the defendants have sold the<br \/>\nsuit land. If the suit is stayed and the matter lingers, more<br \/>\ncomplications may develop.\n<\/p>\n<p>4.<br \/>\n  We<br \/>\nhave heard learned counsel for the appellants, perused the record and<br \/>\nagree with the submission that if the suit remains pending further,<br \/>\nit may complicate the case. For the said reason, we are of the view<br \/>\nthat the learned Single Judge should decide the writ<br \/>\npetition, and decide the question whether the subsequent purchasers<br \/>\nought to have been impleaded as the defendants to the suit or not.<br \/>\nFor the said reason,  we are not interfering with the interim<br \/>\norder. The writ petition<br \/>\nis remitted to the learned Single Judge for its decision on merit.<br \/>\nThe case be given preference over other writ<br \/>\npetitions as the suit is pending<br \/>\nsince long.\n<\/p>\n<p>5.<br \/>\n        Post<br \/>\n Special Civil Application No. 13862 of 2009 before the appropriate<br \/>\nBench on 6th<br \/>\nDecember 2010 within<br \/>\n5 cases.\n<\/p>\n<p>6.<br \/>\n    Letters<br \/>\nPatent Appeal &amp; Civil Application stand disposed of.
