DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tThe<br \/>\nchallenge in this revision application preferred under Section 397<br \/>\nand 401 of Code of Criminal Procedure, 1973 is the order dated<br \/>\n28.2.2011 passed in Criminal Misc. Application No.318 of 2010, by<br \/>\nwhich, bail granted to the applicants came to be cancelled on the<br \/>\nground that the applicants had failed to comply with the conditions<br \/>\nNo. 2 and 7 of the order of the bail dated 28.7.2009 passed in<br \/>\nCriminal Misc. Application No.2168 of 2009 of learned Additional<br \/>\nSessions Judge.\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the applicants submit that charge-sheet is filed on<br \/>\n14.12.2009 and the applicants have attended and gone to mark their<br \/>\npresence at concerned police station but they were told that they<br \/>\nwould be informed if their presence was necessary.\n<\/p>\n<p>\tHowever,<br \/>\nthe above fact is disputed by learned APP and it is submitted that<br \/>\nonce conditions were imposed upon the applicants who were enlarged on<br \/>\nbail, they were duty bound to comply with the conditions and if there<br \/>\nwas any inconvenience, an application for modification, deletion or<br \/>\nrelaxation of the conditions could have been filed.\n<\/p>\n<p>\tBe<br \/>\nthat as it may be and considering the peculiar facts and<br \/>\ncircumstances of this case and one of the applicant is suffering from<br \/>\nheart ailment, at this I am inclined to allow this application by<br \/>\nquashing and setting aside the impugned order dated 28.2.2011 passed<br \/>\nin Criminal Misc. Application No.318 of 2010 and enlarge the<br \/>\napplicants on bail by imposing suitable conditions. \tUnder the<br \/>\ncircumstances, the applicants are ordered to be released on bail in<br \/>\nconnection with C.R. No.I-194 of 2007 with Karanj Police Station, on<br \/>\ntheir furnishing bond of Rs. 5000\/-(Rupees Five Thousand) each with<br \/>\none surety of like amount to the satisfaction of the lower Court and<br \/>\nsubject to following conditions :\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of their liberty or abuse their liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>mark<br \/>\n\ttheir presence before the concerned Police Station on every 1st<br \/>\n\tand 15th day of English Calendar month between 11:00 am<br \/>\n\tto 2:00 pm till the charge is framed;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>furnish<br \/>\n\tthe address of their residence at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of  this<br \/>\n\tCourt;\n<\/p>\n<p>surrender<br \/>\n\ttheir passport, if any, to the Lower Court immediately.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed,  the Sessions<br \/>\nJudge concerned will be free to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.
