Salunke, Counsel for respondent No.2.<br \/>\n      Shri Mohan Sausarkar, Counsel for respondent No.3.<br \/>\n      This order shall decide W.P.7145\/2010, W.P.6221\/2010,<br \/>\nW.P.5984\/10 and         W.P.5709\/10, as a common question is<br \/>\ninvolved for consideration of this Court in all the matters. For<br \/>\nthe convenience, facts are taken from W.P.7145\/2010.\n<\/p>\n<p>      Petitioner has sought following reliefs :-\n<\/p>\n<p>        1. To call for the records from the respondents for<br \/>\n           the satisfaction of this Hon. Court.\n<\/p>\n<p>        2. To command the respondents to grant two grace<br \/>\n           marks to the petitioner in the subject of General<br \/>\n           Pathology and Micro Biology (Theory) by<br \/>\n           issuance of an appropriate writ and or direction.\n<\/p>\n<p>        3. To command the respondents to declare the<br \/>\n           petitioner successful in BDS 2nd year<br \/>\n           examination after allowing him two grace marks<br \/>\n           and to allow him to appear in the 3rd year<br \/>\n           examination by issuance of an appropriate writ<br \/>\n           and or direction.\n<\/p>\n<p>        4. Any other reliefs which this Court may deem<br \/>\n           just and proper in the circumstances of the case<br \/>\n           be also granted in favour of the petitioner<br \/>\n           alongwith cost of this petition.\n<\/p>\n<p>      Case of the petitioners is that as per the revised<br \/>\nRegulations called as Dental Council of India revised BDS Course<br \/>\nRegulations, 2007 Annexure P-4, all the petitioners are entitled<br \/>\nfor grace marks up to maximum 5 marks but the respondent<br \/>\nNo.1 is not granting the aforesaid grace marks to the<br \/>\npetitioners.\n<\/p>\n<p>      Learned      counsels      appearing      for    the     respondent\n<\/p>\n<p>                                                                   2&#8230;..\n<\/p>\n<p>                 W.P. No.7145 of 2010<\/p>\n<p>Dinesh Thakur                        Rani Durgawati Vishvidhyalaya<br \/>\n                                     and ors.\n<\/p>\n<p>29.9.2010<\/p>\n<p>No.1\/University submitted that they have received instructions<br \/>\nfrom the University and considering the peculiar facts of all the<br \/>\ncases in which because of the ad interim writ issued by this<br \/>\nCourt all the petitioners have been permitted to prosecute their<br \/>\nstudies in higher classes, the University has decided to award<br \/>\naforesaid 5 grace marks to all the students.          It is further<br \/>\nsubmitted by them that this order may not be treated as<br \/>\nprecedent in future.\n<\/p>\n<p>      The aforesaid contention is not opposed by the other side.<br \/>\n      In view of the aforesaid statement made on behalf of the<br \/>\nUniversity, no further order is required in this petition. All the<br \/>\npetitions are disposed of finally in terms of the statement made<br \/>\nby Shri P.K. Kaurav and Smt. Jahanvi Pandit. We also allow the<br \/>\ncontentions of the counsels for respondent No.1 that this order<br \/>\nshall not be treated as precedent because this case has not<br \/>\nbeen decided on merits and this issue is left open.\n<\/p>\n<p>      After awarding grace marks to the petitioners, if they are<br \/>\nfound eligible to prosecute studies in the next higher classes and<br \/>\nif they have appeared in the higher classes, respondents shall<br \/>\nalso declare the results of those petitioners for higher class.\n<\/p>\n<p>      No order as to costs.\n<\/p>\n<p>      C.C.as per rules.<\/p>\n<pre>\n\n\n\n (Krishn Kumar Lahoti)                       (Smt.
