No.30395 of 2010\n              SURAJ PRAKASH SINGH, SON OF SHRI SIPAHI SINGH @ SIPAHI\n              MAHTO KUSHWAHA\n                                           Versus\n                                    STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>4.   27.10.2010              Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                             The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under Sections 21 and 22 of N.D.P.S. Act.<\/p>\n<p>                             It has been submitted that for recovery of 13 Kg. of<\/p>\n<p>                  Ganja, the petitioner has remained in custody since 14.3.2010<\/p>\n<p>                  and has fair antecedents.\n<\/p>\n<p>                             Considering the same, let the petitioner above<\/p>\n<p>                  named, be released on bail on furnishing bail bond of Rs.<\/p>\n<p>                  5,000\/- (Five thousand) with three sureties of the like amount<\/p>\n<p>                  each or any other surety to be fixed by the court concerned to<\/p>\n<p>                  the satisfaction of Additional Sessions Judge, VII, Patna, Vide.<\/p>\n<p>                  Spl. Case No. 07 of 2010 arising out of Patna Jn. Case No. 105<\/p>\n<p>                  of 2010 subject to the following conditions: (i) That one of the<\/p>\n<p>                  bailors will be a close relative of the petitioner who will give an<\/p>\n<p>                  affidavit giving genealogy as to how he is related with the<\/p>\n<p>                  petitioner, the 2nd bailor shall be the local and the 3rd bailor shall<\/p>\n<p>                  be the father\/mother\/brother of the petitioner. The bailor will<\/p>\n<p>                  undertake to furnish information to the Court about any change<\/p>\n<p>                  in address of the petitioner. (ii)That the affidavit shall clearly<\/p>\n<p>                  state that the petitioner is not an accused in any other case and<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        if he is, he shall not be released on bail. (iii)That the bailor shall<\/p>\n<p>        also state on affidavit that he will inform the court concerned if<\/p>\n<p>        the petitioner is implicated in any other case of similar nature<\/p>\n<p>        after his release in the present case and thereafter the court<\/p>\n<p>        below will be at liberty to initiate the proceeding for cancellation<\/p>\n<p>        of bail on the ground of misuse.
