B. Civil Writ Petition No.<\/p>\n<p>459\/2007 whereby the learned Single Judge of this Court has<\/p>\n<p>dismissed the writ petition preferred by the petitioner-appellant<\/p>\n<p>against the order dated 12.09.2006 whereby the Labour Court,<\/p>\n<p>Jodhpur refused to set aside the ex parte award dated<\/p>\n<p>12.11.2002.\n<\/p>\n<p>      This appeal, filed only on 07.09.2009, is reported to be<\/p>\n<p>barred by limitation by 881 days and the appellant has moved<\/p>\n<p>an application seeking condonation of delay.<\/p>\n<p>      Briefly put, the relevant facts and background aspects of<\/p>\n<p>the matter are that upon the respondent No.1 Moola Ram<\/p>\n<p>raising an industrial dispute on the allegations that he was<\/p>\n<p>appointed in the month of January 1982 under the Gram<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>Panchayat, Balana as driver of engine and electric motor but<\/p>\n<p>his services were terminated on 01.03.1996, the Government<\/p>\n<p>made a reference to the Labour Court, Jodhpur on the<\/p>\n<p>question of validity of such termination of services.      The<\/p>\n<p>present appellant chose not to appear before the Labour Court<\/p>\n<p>despite service; and on 12.11.2002, the Labour Court<\/p>\n<p>proceeded to make the award ex parte in favour of the<\/p>\n<p>respondent No.1.    The Labour Court held the questioned<\/p>\n<p>termination illegal and further held the respondent-workman<\/p>\n<p>entitled for reinstatement with continuity of services and with<\/p>\n<p>40% back-wages from the date of reference. The award so<\/p>\n<p>made by the Labour Court, Jodhpur came to be published by<\/p>\n<p>the Government of Rajasthan on 13.02.2003.<\/p>\n<p>      Thereafter, on 19.08.2004, the appellant moved an<\/p>\n<p>application under Rule 22-A of the Rajasthan Industrial<\/p>\n<p>Dispute Rules, 1958 for setting aside the ex parte award on<\/p>\n<p>the ground that the notices were not properly served. The<\/p>\n<p>appellant also moved an application for condonation of delay<\/p>\n<p>with the submissions that the fact of making the award came<\/p>\n<p>to the knowledge only when the respondent-workman moved<\/p>\n<p>the application seeking benefits thereunder; and that the delay<\/p>\n<p>was caused in the process of the taking instructions from<\/p>\n<p>higher authorities. By its order dated 12.09.2006, the Labour<\/p>\n<p>Court rejected the application so moved by the appellant for<\/p>\n<p>setting aside the award while observing that the application<\/p>\n<p>had been moved after 30 days from the date of publication of<\/p>\n<p>the award; and the applicant failed to show proper reasons for<\/p>\n<p>condonation of delay. The Labour Court also observed that in<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>view of Section 17-A of the Industrial Disputes Act, 1947, on<\/p>\n<p>the expiry of 30 days from the date of publication, the award<\/p>\n<p>becomes enforceable and thereafter the Labour Court<\/p>\n<p>becomes functus officio; and in this regard, referred to the<\/p>\n<p>decision of the Hon&#8217;ble Supreme Court rendered in the case of<\/p>\n<p>Sangham Tape Co. Vs. Hans Raj [2004(3) LLJ 1141 = (2005)9<\/p>\n<p>SCC 331].\n<\/p>\n<p>      The appellant preferred the writ petition [CWP No.<\/p>\n<p>459\/2007] wherefrom has arisen this appeal, seeking to<\/p>\n<p>challenge the aforesaid order dated 12.09.2006 and the<\/p>\n<p>related award dated 12.11.2002. The learned Single Judge of<\/p>\n<p>this Court proceeded to dismiss the writ petition by the<\/p>\n<p>impugned order dated 09.02.2007 with the observations that<\/p>\n<p>the employer had the opportunity to contest the matter as the<\/p>\n<p>notices had been served; and that there was no reason to<\/p>\n<p>interfere in view of the decision of the Hon&#8217;ble Supreme Court<\/p>\n<p>in the case of Sangham Tape Co. (supra).\n<\/p>\n<p>      Seeking to challenge the order so passed by the learned<\/p>\n<p>Single Judge, the employer has preferred this intra-court<\/p>\n<p>appeal.\n<\/p>\n<p>      It is contended in the appeal that the Labour Court and<\/p>\n<p>the learned Single Judge have erred in dismissing the<\/p>\n<p>application for setting aside the ex parte award on the ground<\/p>\n<p>that the award has become enforceable and the Labour Court<\/p>\n<p>was functus officio after 30 days of publication of award. The<\/p>\n<p>appellant relies on a decision of the Hon&#8217;ble Supreme Court<\/p>\n<p>rendered in the case of     Radhakrishna Mani Tripathi Vs.<\/p>\n<p>L.H.Patel &amp; Anr.: (2009) 1 SCC (L&amp;S) 358. As noticed, this<br \/>\n<span class=\"hidden_text\">                                 4<\/span><\/p>\n<p>belatedly filed appeal is barred by 881 days. An application<\/p>\n<p>seeking condonation of delay in filing the appeal has been<\/p>\n<p>moved by the appellant, the contents whereof are reproduced<\/p>\n<p>verbatim hereunder:-\n<\/p>\n<blockquote><p>             &#8220;The humble appellant most respectfully<br \/>\n       submits as under:\n<\/p><\/blockquote>\n<blockquote><p>       01-    That, the present appeal is being submitted<br \/>\n       on the strong facts and grounds in which fully hope<br \/>\n       to be succeed.\n<\/p><\/blockquote>\n<blockquote><p>       02-    That, the averment made in present appeal<br \/>\n       may kindly be treated part and parcel of the present<br \/>\n       application for condonation of delay.\n<\/p><\/blockquote>\n<blockquote><p>       03-   That, the present appeal is being submitted<br \/>\n       delay because of the Gram Panchayat-appellant<br \/>\n       had sought permission from Panchayat Raj.<br \/>\n       Department and due to administrative process it<br \/>\n       has caused for delay.\n<\/p><\/blockquote>\n<blockquote><p>       04-    That, the respondent- workman has filed a<br \/>\n       writ petition-bearing no. as 6155\/07 Moola Ram V\/s<br \/>\n       B.D.O.Panchayat Samiti&#8217;s &amp; Ors. and the Hon&#8217;ble<br \/>\n       Court vide their order dtd.13.07.2009 disposed the<br \/>\n       writ petition with a direction to the appellant-<br \/>\n       employer to make full compliance of the award and<br \/>\n       it is also directed that appellant-employer can<br \/>\n       obtain all necessary order from wherever, they are<br \/>\n       required. In the present case, the present appellant<br \/>\n       has sent letters, number of times to the higher<br \/>\n       authority, but due to not provided the permission,<br \/>\n       and the delay has been occurred. Hence, the<br \/>\n       present appeal deserves to be condoned its delay.\n<\/p><\/blockquote>\n<blockquote><p>       05-    That, the present appeal involves a<br \/>\n       substantial question of law that whether the ex-<br \/>\n       party award can be set-aside after its publication. If,<br \/>\n       the delay is not Condon in filing the present appeal,<br \/>\n       than, it will be cause for irreparable loss to the<br \/>\n       appellant.\n<\/p><\/blockquote>\n<blockquote><p>              It is therefore, prayed that application for<br \/>\n       condonation for delay may kindly be allowed and<br \/>\n       the present appeal may kindly be heard on merit.&#8221;<\/p><\/blockquote>\n<p>      While relying on the decision in Radhakrishna Mani<\/p>\n<p>Tripathi&#8217;s case (supra), learned counsel for the appellant<\/p>\n<p>strenuously argued that the appellant has a strong case on<\/p>\n<p>merits and the delay deserves to be condoned for having been<\/p>\n<p>caused due to administrative process.\n<\/p>\n<p><span class=\"hidden_text\">                                5<\/span><\/p>\n<p>      After having heard the learned counsel for the appellant<\/p>\n<p>and having perused the material placed on record, we are<\/p>\n<p>unable to find any cause what to say of a sufficient one to<\/p>\n<p>condone the inordinate delay in filing this appeal.<\/p>\n<p>      Even when ordinarily a matter is preferred to be decided<\/p>\n<p>on merits and a slight bona fide cause is taken sufficient, it<\/p>\n<p>cannot be assumed yet that the law of limitation has been<\/p>\n<p>rendered totally redundant. Apart that the delay of more than<\/p>\n<p>2 years in filing this appeal remains unexplained, the cause, in<\/p>\n<p>whatever form stated in the application, shows that the<\/p>\n<p>appellant has not been prosecuting its case bona fide.<\/p>\n<p>Reference has been made in the application to an order dated<\/p>\n<p>13.07.2009 as passed in CWP No.6155\/2007. Having regard<\/p>\n<p>to the circumstances, we have requisitioned the record of<\/p>\n<p>CWP No.6155\/2007 and find that the said writ petition was<\/p>\n<p>filed by the present respondent No.1 Moola Ram with the<\/p>\n<p>submissions    that   though    reinstated   with     effect   from<\/p>\n<p>22.01.2004, he had not been granted the other benefits under<\/p>\n<p>the award.     The facts regarding making of the award,<\/p>\n<p>rejection of the application for setting aside the award, and<\/p>\n<p>dismissal of the writ petition of the employer were all stated in<\/p>\n<p>the writ petition so filed by the workman and such facts were<\/p>\n<p>not disputed by the present appellant in the reply filed in the<\/p>\n<p>said writ petition on 13.02.2008. The award having attained<\/p>\n<p>finality was a fact not even disputed before the learned Single<\/p>\n<p>Judge in the said writ petition (CWP No.6155\/2007) that was<\/p>\n<p>decided on 13.07.2009.\n<\/p>\n<p><span class=\"hidden_text\">                                 6<\/span><\/p>\n<p>      It is thus clear from the record of CWP No.6155\/2007<\/p>\n<p>that the appellant was all through aware of the order dated<\/p>\n<p>09.02.2007, sought to be impugned in this appeal.             It is<\/p>\n<p>beyond comprehension that the appellant yet chose not to<\/p>\n<p>take requisite steps for filing the appeal      against the order<\/p>\n<p>dated 09.02.2007 at the relevant time and even while<\/p>\n<p>contesting the writ petition filed by the workman. The cursory<\/p>\n<p>suggestions about &#8220;administrative process&#8221; as made in the<\/p>\n<p>application for condonation are not only incomplete but turn<\/p>\n<p>out to be more of pretension rather than of any reasonable<\/p>\n<p>cause. It is also not clear as to who was to grant permission<\/p>\n<p>for filing of the appeal to the appellant and as to how the so-<\/p>\n<p>called &#8220;administrative process&#8221; could take over 2 years time?<\/p>\n<p>The delay in filing the present appeal being unreasonable and<\/p>\n<p>inordinate without a sufficient cause therefor, no case is made<\/p>\n<p>out for condonation.\n<\/p>\n<p>      In the aforesaid view of the matter, we do not propose<\/p>\n<p>to deal with the contentions sought to be urged in the appeal<\/p>\n<p>but in that regard too, it cannot be lost sight of that the learned<\/p>\n<p>Labour Court has recorded the specific finding about want of<\/p>\n<p>sufficient cause for condonation of delay in filing the<\/p>\n<p>application for setting aside ex parte award.<\/p>\n<p>      Put in a nutshell, the scenario is that the appellant did<\/p>\n<p>not appear before the Labour Court despite<\/p>\n<p>    service and hence, ex parte award was made on<\/p>\n<p>12.11.2002; the award was published on 13.02.2003 whereas<\/p>\n<p>the application for setting it       aside was filed only on<\/p>\n<p>19.08.2004; and in the meantime, the workman was reinstated<br \/>\n<span class=\"hidden_text\">                                         7<\/span><\/p>\n<p>         on 22.01.2004.    Then, the application for setting aside ex<\/p>\n<p>         parte award was rejected on 12.09.2006 and the writ petition<\/p>\n<p>         filed against the same was also dismissed on 09.02.2007. On<\/p>\n<p>         the other hand, the workman preferred the writ petition<\/p>\n<p>         seeking all the reliefs under the award and referred to the fact<\/p>\n<p>         of dismissal of writ petition filed by the appellant.       The<\/p>\n<p>         appellant did not dispute this fact and suffered the order dated<\/p>\n<p>         13.07.2009 in the said writ petition filed by the workman. An<\/p>\n<p>         attempt thereafter to assail the order dated 09.02.2007 by<\/p>\n<p>         filing this appeal on 07.09.2009 could only be considered<\/p>\n<p>         lacking in bona fide; and cannot be countenanced.<\/p>\n<p>               In an overall view of the matter, we find no reason to<\/p>\n<p>         entertain this grossly belated appeal.     The application for<\/p>\n<p>         condonation of delay stands rejected and the appeal stands<\/p>\n<p>         dismissed.\n<\/p>\n<\/p>\n<pre>         (C.M.TOTLA),J.
