Heard finally<\/p>\n<p>    with consent of Shri Chandurkar, learned Counsel for<\/p>\n<p>    the petitioner, and Shri Kotwal, learned Counsel for the<\/p>\n<p>    respondent no.3.      None appears for the respondent<\/p>\n<p>    nos. 1 and 2 though served.\n<\/p>\n<p>    2)      The above petition filed under Articles 226<\/p>\n<p>    and 227 of the Constitution of India takes exception to<\/p>\n<p>    the order dated 7\/3\/2011 whereby the application<\/p>\n<p>    (Exh. 2) for staying the judgment passed in Misc.\n<\/p>\n<p>    W.C.A. Case No.3\/2008 and the Revenue Recovery<\/p>\n<p><span class=\"hidden_text\">                                            ::: Downloaded on &#8211; 09\/06\/2013 17:24:54 :::<\/span><br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>    Certificate No.71-1\/2010 came to be rejected.\n<\/p>\n<p>    3)    The respondent nos. 1 and 2 are the claimants in<\/p>\n<p>    the said Misc. W.C.A. Case No. 3\/2008. The said claim<\/p>\n<p>    was on account of death of the son of            respondent<\/p>\n<p>    nos. 1 and 2, who was working at the relevant time<\/p>\n<p>    with the petitioner, who was the principal employer<\/p>\n<p>    and the respondent no.3 herein was a Contractor<\/p>\n<p>    employed by the petitioner to carry out certain civil<\/p>\n<p>    works. The said Misc. W.C.A. Case No.3\/2008 came to<\/p>\n<p>    be   allowed and the petitioner and respondent no.3<\/p>\n<p>    were made jointly and severally liable for the amount<\/p>\n<p>    of Rs.1,69,533\/- with interest at the rate of 12% per<\/p>\n<p>    annum from 24\/8\/2000 till its actual realization.             The<\/p>\n<p>    said order records that in spite of service, the<\/p>\n<p>    petitioner did not participate in the said proceedings.\n<\/p>\n<p>    It appears that after the Misc. W.C.A. Case No.3\/2008<\/p>\n<p>    came to be disposed of by order dated 20\/9\/2010, the<\/p>\n<p>    respondent nos. 1 and 2 entered into a settlement with<\/p>\n<p>    the respondent no.3 before the Lok Adalat, pursuant to<\/p>\n<p><span class=\"hidden_text\">                                        ::: Downloaded on &#8211; 09\/06\/2013 17:24:54 :::<\/span><br \/>\n<span class=\"hidden_text\">                                    4<\/span><\/p>\n<p>    which     the     respondent   no.3    paid      an      amount           of<\/p>\n<p>    Rs.1,10,000\/- to the respondent nos. 1 and 2. Hence,<\/p>\n<p>    insofar     as    respondent    no.3    is      concerned,              the<\/p>\n<p>    respondent nos. 1 and 2 have settled the matter.<\/p>\n<pre>\n\n\n\n\n                                                \n    4)         The petitioner herein being aggrieved by the\n\n\n\n\n                                   \n    said      order    dated\n                         ig    20\/9\/2010         passed            by       the\n\n<\/pre>\n<p>    Commissioner (Workmen&#8217;s Compensation) filed an<\/p>\n<p>    application, which was registered as Misc. W.C.A. Case<\/p>\n<p>    No.6\/11 seeking setting aside of the said order on the<\/p>\n<p>    ground that the petitioner was not noticed in the said<\/p>\n<p>    proceedings.         In Misc. W.C.A. Case No.6\/2011, the<\/p>\n<p>    petitioner filed an application for stay, which was<\/p>\n<p>    numbered as Exh.2. The stay was sought on the self<\/p>\n<p>    same ground on which setting aside of the order dated<\/p>\n<p>    20\/9\/2010 was sought inter alia being that no notice of<\/p>\n<p>    the proceedings was served on the petitioner.                          The<\/p>\n<p>    said application (Exh.2) came to be rejected by the<\/p>\n<p>    Commissioner        (Workmen&#8217;s     Compensation)                by      the<\/p>\n<p>    impugned order dated 7\/3\/2011, thereby stay pending<\/p>\n<p><span class=\"hidden_text\">                                                 ::: Downloaded on &#8211; 09\/06\/2013 17:24:54 :::<\/span><br \/>\n<span class=\"hidden_text\">                                   5<\/span><\/p>\n<p>    consideration of Misc. W.C.A. Case No.6\/2011 came to<\/p>\n<p>    be refused.\n<\/p>\n<p>    5)      In the instant petition, which has been filed<\/p>\n<p>    impugning the said order dated 7\/3\/2011, this Court by<\/p>\n<p>    an order dated 22\/3\/2011 had directed the petitioner<\/p>\n<p>    to deposit 50% of the amount payable in terms of the<\/p>\n<p>    order of the Commissioner (Workmen&#8217;s Compensation)<\/p>\n<p>    and furnish solvent surety\/security for the remaining<\/p>\n<p>    50% of the amount.          The learned Counsel for the<\/p>\n<p>    petitioner Shri Chandurkar states that the said order<\/p>\n<p>    has been complied with by the petitioner by depositing<\/p>\n<p>    an   amount       of   Rs.1,60,043\/-   and     that        solvent<\/p>\n<p>    surety\/security    will be furnished by the petitioner in<\/p>\n<p>    the course of the present week.\n<\/p>\n<p>    6)      Since interest of the respondent nos. 1 and 2<\/p>\n<p>    is now adequately protected, in my view the interest of<\/p>\n<p>    justice would be served if the impugned order dated<\/p>\n<p>    7\/3\/2011 is set aside and the application (Exh.2) is<\/p>\n<p><span class=\"hidden_text\">                                           ::: Downloaded on &#8211; 09\/06\/2013 17:24:54 :::<\/span><br \/>\n<span class=\"hidden_text\">                                    6<\/span><\/p>\n<p>    consequently allowed and stay to operate pending the<\/p>\n<p>    decision in Misc. W.C.A. Case No.6\/2011. The amount<\/p>\n<p>    deposited by the petitioner in this Court as well as the<\/p>\n<p>    solvent surety\/security that will be furnished by the<\/p>\n<p>    petitioner in the course of this week to be transmitted<\/p>\n<p>    to    the   Commissioner      (Workmen&#8217;s      Compensation),<\/p>\n<p>    Wardha.         The ig     Commissioner              (Workmen&#8217;s<\/p>\n<p>    Compensation) thereafter to hear and decide Misc.\n<\/p>\n<p>    W.C.A. Case No.6\/2010 as expeditiously as possible<\/p>\n<p>    and within a period of four weeks of the first<\/p>\n<p>    appearance      of   the   petitioner   before      him.
