\n\tMajdur Sena and Dakshin Gujarat Kamdar Parishad, a Registered Trade
\n\tUnions having Registration No. G.5313 and G.5134 respectively and
\n\tlearned AGP Mr. AL Sharma for respondents.\n<\/p>\n
Petitioners
\n\thave challenged order passed by Registrar of Trade Unions dated 1st
\n\tApril, 2011 while exercising power under section 10 of Trade Unions
\n\tAct, 1926 cancelling registration of both unions by same dated
\n\torder.\n<\/p>\n
Learned
\n\tAGP Mr. Sharma appering for respondent raised contention before this
\n\tCourt that against order of cancellation of registration passed by
\n\tRegistrar of Trade Unions under sec.10 of Trade Unions Act, 1926,
\n\tappeal is available to both petitioners under section 11(aa) of
\n\tTrade Unions Act,1926. He also submitted that as per Gujarat
\n\tAmendment made vide Gujarat Act 7 of 1962, sec. 6 (w.e.f. 1.7.1962),
\n\tsection 11A has been inserted after section 11 which provides for
\n\tappeal to Industrial Court where State Government is appropriate
\n\tGovernment. Considering his submissions, whole section 11 of Trade
\n\tUnions Act, 1926 is quoted as under:\n<\/p>\n
“11.\n<\/p>\n
\tAppeal. – (1) Any person
\n\taggrieved by any refusal of the Registrar to register a Trade Union
\n\tor by the withdrawal or cancellation of a certificate of
\n\tregistration may, within such period as may be prescribed, appeal –\n<\/p>\n
\t(a) where the head
\n\toffice of the Trade Union is situated within the limits of a
\n\tPresidency town to the High Court, o r <\/p>\n
\t(aa)\twhere the head
\n\toffice is situated in an area, falling within the jurisdiction of a
\n\tLabour Court or an Industrial Tribunal, to that Court or Tribunal,
\n\tas the case may be;\n<\/p>\n
\t(b) where the head
\n\toffice is situated in any area to such Court, not inferior to the
\n\tCourt of an additional or assistant Judge of a principal Civil Court
\n\tof original jurisdiction, as the appropriate Government may appoint
\n\tin this behalf for that area.\n<\/p>\n
(2)\tThe
\n\tappellate Court may dismiss the appeal or pass an order directing
\n\tthe Registrar to register the Trade Union and to issue a certificate
\n\tof registration under the provisaions of section 9 or setting aside
\n\tthe order or withdrawal or cancellation of the certificate
\n\tas the case may be, and the Registrar shall comply with such order.\n<\/p>\n
\t(3)\tFor the purpose of
\n\tan appeal under sub section (1) an appellate Court shall, so far as
\n\tmay be, follow the same procedure and have the same power as it
\n\tfollows and has when trying a suit under the Code of Civil
\n\tProcedure, 1908 (5 of 1908) and may direct by whom the whole or any
\n\tpart of the costs of the appeal shall be paid and such costs shall
\n\tbe recovered as if they had been awarded in a suit under the said
\n\tCode.\n<\/p>\n
(4)<\/span><\/p>\n
\tIn the event of the dismissal of an appeal by any court appointed
\n\tunder clause (b) of sub section (1) the person aggrieved shall have
\n\ta right of appeal to the High Court, and the High Court shall, for
\n\tthe purpose of such appeal, have all the powers of the appellate
\n\tcourt under sub section (2) and (3), and the provisions of those sub
\n\tsections shall apply accordingly.”\n<\/p>\n
Section
\n\t11A inserted after section 11 vide Gujarat Act 7 of 1962, sec. 6
\n\t(w.e.f. 1.7.1962) is also quoted as under:\n<\/p>\n
“Gujarat.-\n<\/p>\n
\tAfter section 11, insert following section, namely:-\n<\/p>\n
“11A.\n<\/p>\n
\tAppeal to Industrial Court in certain cases.- (1) Notwithstanding
\n\tanything contained in sub section (1) of section 11 of the case of a
\n\tTrade Union in relation to which the State Government is the
\n\tappropriate Government, any person aggrieved by any refusal of the
\n\tRegistrar to register such Trade Union or by withdrawal or
\n\tcancellation of a certificate of registration
\n\tmay within such period as may be prescribed, appeal to the
\n\tIndustrial Court. The decision of the Industrial Court in such
\n\tappeal shall be final.\n<\/p>\n
\t(2) \tIn respect of an
\n\tappeal under sub-section (1), the Industrial Court shall have the
\n\tsame power and follow the same procedure as an appellate Court and
\n\tfollows under sub section (2) and (3) of section     11″\n<\/p>\n
[Vide
\n\tGujarat Act 7 of 1962, sec. 6 (w.e.f. 1.7.19620.]”\n<\/p>\n
Therefore,
\n\tpetitioner is having alternative statutory remedy to approach
\n\tIndustrial Court by way of appeal against order under section 10 of
\n\tTrade Unions \tAct, 1926. Therefore, complete remedy is available to
\n\tpetitioner to challenge order in question, under section 11(aa) and
\n\tas per State Amendment as referred to above. Therefore, this
\n\tpetition is not entertained by this Court only on that ground.
\n\tRecently, apex court has, in case of Transport and Dock Workers
\n\tUnion versus Mumbai Port Trust and another, reported in 2011 (2)
\n\tSCC page 575, observed as under in paragraph 14:\n<\/p>\n
“14.\t\tIn
\n\tour opinion the writ petition filed by the appellants should have
\n\tbeen dismissed by the High Court on the ground of existence of an
\n\talternative remedy under the Industrial Disputes Act. It is well
\n\tsettled that writ jurisdiction is discretionary jurisdiction, and
\n\tthe discretion should not ordinarily be exercised
\n\tif there is an alternative remedy available to the appellant. In
\n\tthis case there was a clear alternative remedy available to the
\n\tappellant by raising an industrial dispute and hence we fail to
\n\tunderstand why the High Court entertained the writ petition. It
\n\tseems to us that some High Courts by adopting an over liberal
\n\tapproach are unnecessarily adding to their load of arrears instead
\n\tof observing judicial discipline in following settled legal
\n\tprinciples. However, we may also consider the case on merits.”\n<\/p>\n
In
\n\tview of aforesaid observations made by apex court, when petitioner
\n\tis having alternative effective statutory remedy of appeal under
\n\tAct, then, petition is not to be entertained by this Court. That
\n\tview has been taken by apex court in aforesaid case. Accordingly,
\n\tthis petition is not entertained by this Court on that ground alone
\n\tand same is therefore, disposed of accordingly without expressing
\n\tany opinion on merits  with a liberty in favour of petitioner to
\n\tavail remedy available under section 11A of Trade Unions Act, 1926.\n<\/p>\n
