B. Upadhyaya, learned advocate appearing for \tthe \tpetitioner<br \/>\n\tand perused the memo of petition as well as \tthe \tdocuments<br \/>\n\t\tattached therewith.\n<\/p>\n<p> 2.<br \/>\n\t   Considering the facts and circumstances of the case, notice be<br \/>\n\t\tissued to the respondents making it returnable on 24.01.2011.<br \/>\n\t\tAd-interim relief in terms of paragraph 7 (b) is granted on<br \/>\n\t\tcondition that the petitioner shall deposit an amount of<br \/>\n\t\tRs.50,000\/- with the Mamlatdar, Alien Recovery \tDepartment,<br \/>\n\tAhmedabad, the respondent No.2 herein, on or \tbefore the returnable<br \/>\n\tdate.  D.S. Permitted today. &#8221;\n<\/p>\n<p>3.\tToday<br \/>\nthe matter was called out. Mr. Bhatt learned Advocate appearing for<br \/>\nthe workman contended that the petitioner has adopted smart practice<br \/>\nand he has not even joined the affected workman in whose favour the<br \/>\ncertificate is annuring. Besides the amount which is amount of<br \/>\nRs.50,000\/-, which was to be deposited with the Mamlatdar, Alien<br \/>\nRecovery Department, Ahmedabad, as a condition precedent for granting<br \/>\nstay has also not been deposited and only Rs.10,000\/- have been<br \/>\ndeposited. Learned Advocate Shri Upadhyay for the petitioner<br \/>\nsubmitted that it was a genuine mistake in not joining the concerned<br \/>\naffected workman as a party. There was no intention to play smart<br \/>\npractice with the Court and as the petitioner is in very precarious<br \/>\ncondition she does not have any deposit of Rs.50,000\/-, therefore two<br \/>\ndays time may be granted and stay may be extended.\n<\/p>\n<p>4.\tLooking<br \/>\nto the opposition and objection of Shri Bhatt, learned Advocate of<br \/>\nthe workman, and the fact that no record or even application is<br \/>\npressed into  service<br \/>\nindicating on oath the difficulties on the part of the petitioner in<br \/>\naccumulating Rs.50,000\/- and depositing the same, this Court would<br \/>\nnot be in a position to continue with the stay which was conditional.<br \/>\nIn fact, no order is required to be made by this Court as the order<br \/>\nitself is conditional upon depositing Rs.50,000\/- and that the amount<br \/>\nis not deposited, stay cannot be said to be continued. Hence, the<br \/>\nMamlatdar and other respondents are at liberty to take out the course<br \/>\navailable to them in law as if no stay is existing.
