Justice ANTONY DOMINIC\n\n Dated :10\/01\/2008\n\n O R D E R\n                      ANTONY DOMINIC, J.\n                    ===============\n                  W.P.(C) NO. 1147 OF 2008 J\n                =====================\n\n           Dated this the 10th day of January, 2008\n\n                         J U D G M E N T\n<\/pre>\n<p>        The petitioner was a participant in the Mohiniyattam, in<\/p>\n<p>which she has secured second prize with A grade. It is stated<\/p>\n<p>that aggrieved by the ranking, she filed and appeal, however the<\/p>\n<p>result of the appeal has not been communicated. It is on that<\/p>\n<p>premise this writ petition has been filed praying for an order<\/p>\n<p>permitting her to participate in the State School Youth Festival<\/p>\n<p>Competition.    Learned counsel for the petitioner contend that<\/p>\n<p>appeal has not been disposed of even as of now.<\/p>\n<p>      2.   Learned Government pleader on instructions submits<\/p>\n<p>that appeal has been considered and the same has been rejected.<\/p>\n<p>It is also pointed out by the learned Government Pleader that all<\/p>\n<p>the three judges have uniformly assessed first prize winner to be<\/p>\n<p>superior to the petitioner and that the difference in the total<\/p>\n<p>WPC 1147\/08<br \/>\n<span class=\"hidden_text\">                                 :2 :<\/span><\/p>\n<p>marks is only three.\n<\/p>\n<p>      3.   Yet another contention raised by the petitioner is<\/p>\n<p>regarding the partiality of the judges. It is contended that the 5th<\/p>\n<p>respondent has secured first prize.      It is submitted that the<\/p>\n<p>instructor of the 5th respondent was the colleague of one of the<\/p>\n<p>judges and therefore the judge had favoured the 5th respondent.<\/p>\n<p>This is a wild submission and I am not prepared to take it at its<\/p>\n<p>face value.    The fact that an instructor and a judge were<\/p>\n<p>colleagues by itself does not lead to an inference touching open<\/p>\n<p>the impartiality of the judge concerned. In the absence of any<\/p>\n<p>materials, this argument is only to be stated and rejected.<\/p>\n<p>      4.   Yet another contention that was raised was during the<\/p>\n<p>course of the performance, the child in question had suffered an<\/p>\n<p>injury and that affected her performance. It is stated that the<\/p>\n<p>authorities ought to have provided a safe stage for the<\/p>\n<p>performance of the child and that in the absence of which, the<\/p>\n<p>child cannot be faulted even if the performance was not up to the<\/p>\n<p>mark. I am not prepared to accept this contention either. If the<\/p>\n<p>child had infact suffered an injury as contended by the petitioner,<\/p>\n<p>WPC 1147\/08<br \/>\n<span class=\"hidden_text\">                                  :3 :<\/span><\/p>\n<p>they could have asked for yet another opportunity to prove their<\/p>\n<p>merit and this has not been done and on the other hand, the<\/p>\n<p>petitioner opted to continue the performance.
