Balachandran, J.\n            --------------------------\n             W.P.(C)No.15357 of 2006 C\n            --------------------------\n\n                     JUDGMENT\n<\/pre>\n<p>    Petitioner is the defendant in O.S.No.100\/04 on<\/p>\n<p>the file of the II Additional Munsiff&#8217;s Court,<\/p>\n<p>Kozhikode.  The  suit  is   one  for  damages   for<\/p>\n<p>malicious prosecution.  A petition for amendment of<\/p>\n<p>the plaint was filed by the respondents, who were<\/p>\n<p>the plaintiffs in the suit, which, according to the<\/p>\n<p>petitioner, was in an attempt to see that question<\/p>\n<p>of limitation is circumvented and therefore, the<\/p>\n<p>amendment was opposed by filing a counter. But,<\/p>\n<p>however, the court below allowed the amendment by<\/p>\n<p>Exhibit P4 order.   Though the prayer in the writ<\/p>\n<p>petition is to set aside Exhibit P4 order or in the<\/p>\n<p>alternative to direct the court below to re-hear<\/p>\n<p>the amendment application (I.A.No.834\/06), counsel<\/p>\n<p>for the petitioner submits that petitioner was<\/p>\n<p>constrained to file this writ petition advancing<\/p>\n<p>such a prayer, as the court below, while allowing<\/p>\n<p>amendment of the plaint, has made an observation to<\/p>\n<p><span class=\"hidden_text\">WPC 15357\/06               2<\/span><\/p>\n<p>the   effect    that  the  suit  is  not  barred  by<\/p>\n<p>limitation.     According to him, he does not find<\/p>\n<p>fault with for having allowed the amendment of the<\/p>\n<p>plaint, but at the same time, the question as to<\/p>\n<p>whether the suit is barred by limitation is a<\/p>\n<p>matter to be decided after raising issues and<\/p>\n<p>adducing evidence and on the materials that are<\/p>\n<p>furnished before court and that in view of the<\/p>\n<p>observations in Exhibit P4 order, petitioner may<\/p>\n<p>not be estopped from raising contentions in the<\/p>\n<p>suit that the suit is barred by limitation.<\/p>\n<p>     2.     Counsel for the respondents submits that<\/p>\n<p>the question of limitation was considered by the<\/p>\n<p>court only because it was so argued by the counsel<\/p>\n<p>for   the   petitioner  and  that in  fact  such an<\/p>\n<p>observation would not have been warranted while<\/p>\n<p>allowing     the   amendment  application.
