 liieiacts leading to this appeal are as under:<\/p>\n
it   {a) One Sri Gowdara Karibasappa, was the<\/p>\n
ancestor of the respondent Nos.8 to 12<\/span>
\nin the writ petition and he was in
\npossession and enjoyment of the land in<\/p>\n
question i.e., Sy.No.l2\/4, measuring 5<\/span><\/p>\n
~  h’isp”‘orde’r”‘dated 15.05.1975<\/p>\n
acres 17 guntas situate at Ukkadagatri
\nVillage, Harihar Taluk as a Patel of the
\nVillage.\n<\/p>\n
land. Thereafter, it Vested with <\/p>\n
Government with the passing of  <\/p>\n
The said land was an inam<\/p>\n
Karnataka Village Offices Ab01i_tiOn-:.:g%h(#f;.’:: =<\/p>\n
The said Gowdara <\/p>\n
application for regrant of Sy.N0s’.i2’\/4; it
\n12\/7, 13\/8, 37’\/4_?jo-~…;35\/4 _ami’~_3a;\/’4-~V <\/p>\n
measuring, in all 21____a’e.r_es_p28 guntas
\nsituate at U’i:l:{a-dagatzri  _ Harihara

\nV  Kariba”sappa, his children viz.,<\/p>\n
 wl.re.s:pondent Nos.8 to 12 inherited the<\/p>\n
  They sold the said lands<\/p>\n
.  a Registered Sale Deed dated<\/p>\n
Vl}_2O.O7.1998 in favour of the appellant<\/p>\n
herein.\n<\/p>\n
After such purchase, on
\n02.11.1998, the respondent Nos.2 to 7<\/span>
\nin this appeal preferred an appeal under
\nthe provisions of the Karnataka Village<\/p>\n
Offices Abolition Act, 1961 challenging<\/p>\n
it\/its<\/p>\n

the order of grant only in respect of
\nSy.No.12\/4 measuring 5 acres 17
\nguntas. The learned District Judge.”-.<\/p>\n
ailowed the appeal by an order Dated’–w.’f”-\u00ab_;”‘*,u

order passed by the  ._
\nCommissioner. Aggrieiieddllbgrv the’
\norder, the appellant a
\nwrit petition berm; this court 7-[on
\n11.07.2007. The  Single: i_;J’uc1ge
\nsetwaside the’order_   the
\nDistrict Judge’ and  matter<\/p>\n
back 4_tohin1Wfor.t. fresh__ consideration.<\/p>\n
    appellant is<\/p>\n

__\u00a73″. rrh\u00e9  Counsel for the appeilant<\/p>\n
   the order of regrant was passed on<\/p>\n
the appeal challenging the grant in<\/p>\n
a respect  the land in dispute was filed before the<\/p>\n
llV’40ljilisitripctlldudge in the year 1998 i.e., after lapse of -23<\/p>\n
  An application was filed under Section 14 of<\/p>\n
  Limitation Act seeking condonation of the deiay.<\/p>\n
Subsequently, the said application was not pressed<\/p>\n
and accordingly it came to be dismissed. The ieamed<\/p>\n
District Judge was of the View that as the respondent
\nNos.2 to 7 were not parties to the original proceedings
\nof regrant and they came to know of the same onlyflin<\/p>\n
the year 1998 when the legal representatives”–oi’;theT  <\/p>\n
original grantee sold the property in fa\\rouifi.Vvot.::the xv” <\/p>\n
appellant and therefore the appeal
\nHe set\u00ab~aside the order on the .g.1~ound_lthat
\nNos.2 to 7 were not heard in tlh’ellpvniatter”andltherefore
\nthe impugned order   l’b_e..ll’set–aside: The<\/p>\n
learned Single ..I.udge_dec_linedAto with the<\/p>\n
said oifldelrl of the ground that the
\nfinding reco’rded..1.Jy:.th:e”l\u00a7i’s\u00abtrict Judge on the question<\/p>\n
of condonation ofidelay is in accordance with law and<\/p>\n
  the persons who were claiming regrant<\/p>\n
I ‘werie  in the matter and therefore he<\/p>\n
declined”tdihterfere with the order and directed the<\/p>\n
JD.iSt_rictV*@.Judge to hold an enquiry afresh, after<\/p>\n
 –affording an opportunity to ail the parties and to<\/p>\n
it  “decide the appeal. According to the learned Counsel<\/p>\n
for the appellant, the said order is erroneous and<\/p>\n
requires to be interfered with.\n<\/p>\n<\/p>\n
4. From the aforesaid material on record, it is
\nclear that the land in question was a Patelike inam<\/p>\n
land. One Karibasappa had \ufb01led an application.l_lo.nr~.__<\/p>\n
16.05.1975 for regrant of the same and it   ~<\/p>\n
regranted. However. the contesting
\ncontend that it is one
\nwho was holding the said
\ndate and therefore, there wasdxan ‘obligatig-ii. on
\nthe authorities under  the said<\/p>\n
person to pay.-the    the said<\/p>\n
land.  anj\/’l?rate\u20ac;.Vlas._ti*ieyare the persons who are
\nentitled to regrant;.dj”\\lrh:ey,:’:ph’aiIe not been heard in the<\/p>\n
procfsedings and ‘therefore the order of regrant insofar<\/p>\n
 concerned is Vitiated and liable to be<\/p>\n
“‘set\u00a5_aside’;’* ._ ~ ‘ v V <\/p>\n
 5,.__v”i’h.e:’~”contesting respondents have not filed any<\/p>\n
v\ufb02dapplication under Section 5 of the Act for such<\/p>\n
  regrant. In the absence of such an application, at<\/p>\n
 “their instance, the order of regrant could not have<\/p>\n
been setwaside. It is in these circumstances, the<\/p>\n
authority has to consider the question whether it is<\/p>\n
Gowdara Karibasappa or Shivapiiji
\nSannakaribasappa who was the person in whose<\/p>\n
name the Village Office stood as on the appointed.<\/p>\n
date entitled to regrant of the said  <\/p>\n
Similarly, the question is, without
\nbeing \ufb01led, a person would be
\nunder the Act is also to be con_svidered,l”a.s tliie’
\nregrant dated 16.05.1975  K  without
\nirnpleading Shivapuji  or his legal<\/p>\n
representatives esince.-” ‘- also  clavirn regrant.<\/p>\n
Therefore, th’elv:’.leaVr:ned.Single_–iliidge was justified in
\nholding .that l it   inatter which requires<\/p>\n
reconsideration District Judge after hearing all<\/p>\n
the  concerned.\n<\/p>\n
it   of the matter, we do not see any<\/p>\n
V V’ _ intir’rnit}..\u00a7'”i_n,the said order. Insofar as the limitation is<\/p>\n
 concerned, as the contesting respondents admittedly<\/p>\n
lwere’*’lnot parties to the order of regrant dated<\/p>\n
it  “ld.05.l975, the appeal filed by them was within the<\/p>\n
it period of limitation from the date of their knowledge<\/p>\n
of the order as held by the learned District Judge as<\/p>\n
well as the learned Single Judge. We do not see any<\/p>\n
reason for interfering with the said orders.<\/p>\n
7. However, we have to malge_it clear  <\/p>\n
Gowdara Karibasappa sought
\nin respect of six Sy. Numbe:*s_V.
\nregarding only one Sy. No.3y_..4.l.l”h.erefore.l  Diistrict
\nJudge was not justifiedthinl the entire
\norder of the Assist_ant  there was no
\nclaim in respectg Therefore it is
\nmade Ifwhatlydg  set-Vaside by the learned
\nSingle :V\u00a7l_u’c”lge’VV  the subject matter of<\/p>\n
ad}’udication_Vaa before A’.the..”-7District Judge is only in<\/p>\n
 ._Vrespfe3et  the laiidhearing Sy.No.12\/4 measuring 5<\/p>\n
 acres. T1′? guntae. and in respect of the remaining five<\/p>\n
itenisfof  which is the subject matter of the<\/p>\n
‘rorder ofvithe Assistant Commissioner, the order of the<\/p>\n
 Commissioner stands and the land in other<\/p>\n
   Nos. granted in favour of Karibasappa stands, as<\/p>\n
 there is no challenge from any quarter. Insofar as<\/p>\n
Sy.l\\lo.12\/4 is concerned, the learned District Judge<\/p>\n
shall decide the following questions:  \/-<\/p>\n
i] Who was the holder of the Village<\/p>\n
Office as on the appointed date ‘E’<\/p>\n
ii] Who are the legal representatives of T T
\nShivapuji Sannakribasappa entitleri f  =
\nto regrant even without \ufb01ling
\napplication under the  ‘? ‘h V <\/p>\n
iii) In terms of the provisions’of:’the }kct’;
