SIRI JAGAN, J.\n                  -----------------------------------\n                     W.P.(C) No.34479 OF 2010\n                ---------------------------------------\n           Dated this the 16th day of November, 2010\n                               JUDGMENT\n<\/pre>\n<p>     The petitioner is presently working as Superintendent of ESI<\/p>\n<p>Hospital, Thrissur since 12.6.2009. The petitioner has now been<\/p>\n<p>promoted as Joint Director of Insurance Medical Services.<\/p>\n<p>According to the petitioner, the petitioner has submitted Ext.P11<\/p>\n<p>statement of relinquishment of promotion stated to be as<\/p>\n<p>directed by the Government in Ext.P9.                However, by Ext.P15<\/p>\n<p>order, the petitioner has now been directed to be relieved to take<\/p>\n<p>charge of the promoted post without passing orders on Ext.P11.<\/p>\n<p>According to the petitioner, as per the Government orders in<\/p>\n<p>force, the petitioner cannot be forced to take up the promoted<\/p>\n<p>post, when the petitioner has already submitted Ext.P11<\/p>\n<p>statement of relinquishment of promotion to the post. Therefore,<\/p>\n<p>the petitioner seeks the following reliefs:<\/p>\n<blockquote><p>         &#8220;i)    issue a writ of Certiorari or other appropriate writ,<br \/>\n         direction or order calling for the records leading to Ext.P-<br \/>\n         14 and P-15 and quash the same.\n<\/p><\/blockquote>\n<blockquote><p>         ii)    issue a writ of Mandamus or other appropriate<br \/>\n         writ, direction or order directing the 1st respondent to<br \/>\n         accept the Ext.P-11 statement of relinquishment of<br \/>\n         promotion as Joint Director\/Regional Deputy Director in<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.34479\/10                   2<\/span><\/p>\n<p>         the Insurance Medical Services, submitted by the<br \/>\n         petitioner.\n<\/p><\/blockquote>\n<blockquote><p>         iii)   to declare that Ext.P-16 Government order is<br \/>\n         not in force and in applicable being revised by Ext.P-<br \/>\n         17 Government order or to declare the Guideline No.\n<\/p><\/blockquote>\n<blockquote><p>         (vi) in paragraph 3 of Ext.16 Government Order is null<br \/>\n         and void.\n<\/p><\/blockquote>\n<blockquote><p>         iv)    to issue a writ of Mandamus or other<br \/>\n         appropriate writ, direction or order directing the 2nd<br \/>\n         respondent to revise Ext.P-12 seniority list of<br \/>\n         Insurance Medical Officers assigning the petitioner<br \/>\n         proper ranking taking into account her eligible<br \/>\n         qualified service on the basis of Ext.P-1 Government<br \/>\n         order and to direct the 1st respondent to review the<br \/>\n         Ext.P-15 promotion to the post of Joint Director of<br \/>\n         Insurance Medical Services Department accordingly.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>      2.     I have heard the learned Government Pleader also.\n<\/p><\/blockquote>\n<p>I am of opinion that, when the petitioner has submitted<\/p>\n<p>Ext.P11 relinquishment statement, the appropriate authority<\/p>\n<p>has a duty to consider and pass orders on the same before the<\/p>\n<p>petitioner can be directed to take charge in the promoted post.<\/p>\n<p>      Accordingly, this writ petitioner is disposed of with a<\/p>\n<p>direction to the first respondent to consider and pass orders on<\/p>\n<p>Ext.P11 as expeditiously as possible. Till orders are passed on<\/p>\n<p>Ext.P11, the petitioner shall not be relieved from ESI Hospital,<\/p>\n<p>Thrissur to join the post which the petitioner has been<\/p>\n<p>promoted.      The petitioner shall be afforded an opportunity of<\/p>\n<p>being heard before passing orders on Ext.P11. It would be<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.34479\/10                3<\/span><\/p>\n<p>open to the petitioner to rely on any order in favour of the<\/p>\n<p>petitioner, the applicability of which shall also be considered by<\/p>\n<p>the Government.\n<\/p>\n<\/p>\n<p>                                    S.
