Since then the application<br \/>\nhas not been prosecuted further.  The notice of the process issued by<br \/>\nthe Court has remained unserved and said notice is not received back<br \/>\nsince 1996.  Neither the applicant nor the opponents have thereafter<br \/>\ntaken steps to carry the application and\/or the appeal further and to<br \/>\nprosecute the same.  The opponents have remained unserved since last<br \/>\n14 years.  It is obvious that by now the award must have been<br \/>\nexecuted.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr. S. B. Parikh for Mr. Rajni Mehta, learned advocate<br \/>\nappearing for the applicant has submitted that the applicant had<br \/>\ndeposited the amount before the Trial Court at the material point of<br \/>\ntime.  In absence of any directions during last 14 years, the amount<br \/>\nmust have been paid\/disbursed to the claimants.  Hence any fruitful<br \/>\npurpose will not be served even if the application for condonation of<br \/>\ndelay is granted.\n<\/p>\n<p>\tThus,<br \/>\nin view of the fact that for last 14 years, the opponents have not<br \/>\nbeen served with the process of the Court, present application fails<br \/>\nfor non prosecution and accordingly it is dismissed for non<br \/>\nprosecution.
