Alongwith the suit,<br \/>\napplication Exh.5 for interim injunction was filed.  In the meantime,<br \/>\nrespondent No.2\/1 to 2\/4 filed the impugned application below Exh.21<br \/>\nfor impleading them as defendant in the suit. The said application<br \/>\nwas opposed but the Court below without appreciating the facts and<br \/>\ncircumstances of the case, allowed the said application which has<br \/>\ngiven rise to the present petition.\n<\/p>\n<p>3.\t\tLearned<br \/>\nAdvocate for the petitioner has mainly contended that the Court below<br \/>\nhas not considered the reply filed by the petitioner and the<br \/>\nauthorities cited by petitioner and the order of allowing the<br \/>\nrespondent No.2\/1 to 2\/4 to be joined as party defendant in the suit<br \/>\nit will change the entire nature of the suit.  He, therefore,<br \/>\nsubmitted that the order of the Court below may be quashed and set<br \/>\naside.\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard the learned Advocate for the petitioner and having perused the<br \/>\norder impugned in the petition, this Court is in complete agreement<br \/>\nwith the findings recorded and conclusion arrived at by the Court<br \/>\nbelow.  This Court is of the opinion that petitioner is the defendant<br \/>\nin the suit and it is for the original plaintiff to challenge such an<br \/>\norder as to whether such party is permitted to be joined as party<br \/>\ndefendant or not.  The petitioner in the capacity of defendant cannot<br \/>\nchallenge such an order. I am of the opinion that allowing the<br \/>\nrespondent Nos.2\/1 to 2\/4 as party defendants in the suit, would not<br \/>\nprejudice the rights of the petitioner as a defendant in the suit.<br \/>\nThe petition is devoid of merits and requires to be dismissed.<br \/>\nAccordingly, the petition is dismissed.
