Nath, A.P.P.\n\n\n4   24.08.2011<\/pre>\n<p>             Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                           Perused the report kept at Flag &#8216;A&#8217; and the<\/p>\n<p>                  affidavit filed on behalf of the Sr. S.P. Patna.<\/p>\n<p>                              Petitioner seeks bail in a case registered for<\/p>\n<p>                  offences punishable under Sections 302 and 328 of the<\/p>\n<p>                  Indian Penal Code.\n<\/p>\n<p>                              Petitioner&#8217;s prayer has been rejected earlier on<\/p>\n<p>                  twice vide Annexure 2 series.\n<\/p>\n<p>                              It is submitted that the deposition of the<\/p>\n<p>                  mother of the deceased before the trial court shows<\/p>\n<p>                  contradiction from her stand taken before the police and<\/p>\n<p>                  the charges have been framed on 11.5.2010 itself but<\/p>\n<p>                  only three witnesses have been examined till date,<\/p>\n<p>                  though they are the family members of the deceased.<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>              In the counter affidavit filed on behalf of the<\/p>\n<p>Sr. Superintendent of Police, Patna,            it has been<\/p>\n<p>categorically stated that      the rest witnesses would be<\/p>\n<p>examined within six months.\n<\/p>\n<p>              In view of the gravity of the allegation made<\/p>\n<p>in the first information report and the materials collected<\/p>\n<p>in course       of investigation   including viscera report<\/p>\n<p>which shows presence            of celphos in the sample<\/p>\n<p>concerned, I am not inclined           to grant bail to the<\/p>\n<p>petitioner.\n<\/p>\n<p>              Accordingly, this application is dismissed.<\/p>\n<p>              On the earlier occasion the trial court was<\/p>\n<p>directed to dispose of the trial within nine months and<\/p>\n<p>Sr. Superintendent of Police , Patna was also required<\/p>\n<p>to take every step for ensuring         the presence of the<\/p>\n<p>prosecution witnesses on the date fixed by the trial<\/p>\n<p>court, even then, however, no official witnesses have<\/p>\n<p>been examined. However, in view of the categorical<\/p>\n<p>statement       taken in paragraph no. 9 of the counter<\/p>\n<p>affidavit, it is expected from the Sr. S.P., Patna to<\/p>\n<p>ensure   that the rest        prosecution   witnesses       are<\/p>\n<p>produced on the date fixed by the trial court as per his<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>        undertaking. It is also expected from the trial court to<\/p>\n<p>        take every step for expeditious disposal         of the trial<\/p>\n<p>        court preferably within seven months from the date of<\/p>\n<p>        receipt\/production of a copy of this order.<\/p>\n<p>                  If the trial is not concluded within the<\/p>\n<p>        aforesaid period then,     if so advised,      the petitioner<\/p>\n<p>        would be at liberty to renew his prayer for bail.<\/p>\n<p>                  Let a copy of this order be handed over to<\/p>\n<p>        the learned counsel appearing        for the State for<\/p>\n<p>        communication and compliance.\n<\/p>\n<\/p>\n<pre>Spd\/-                         ( Dr. Ravi Ranjan, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.
