This writ petition is filed under Articles 226 and 227 of
\nthe Constitution of India praying to quash the endorsement
\ndated 26.4.2010 issued by the respondent No.4, vide Annexure\u00bb
\nW and etc. 7 <\/p>\n
This petition coming on for Preliminary  r-iiroupp
\nthis day. the Court made the foilowingh   ..  –.  ~<\/p>\n

1. In this writ petition, Vpetitixonerii is cl_i_.alleri~giVI1\u00a7._,\/the<\/p>\n
endorsement dated 26.04.20 j5sue.d’.,  j”-this’avril’ah’sildar,V
\nChikballapur — respondent “r.eJ’ecti’n’g””hisV\u00a7request to
\nenter his name in the  the lands bearing
\nSy.No.20 measupringg   ‘measuring 38 guntas
\nof    _Chikballapur Taluk and<\/p>\n
District.  —-  .\n<\/p>\n
2. Petitio__ner has  “entering his name in the khatha<\/p>\n
in respect of aforementioned lands alleging that the said<\/p>\n
. itlandhasEabeerit.pgranteldwin his favour and a saguvali chit dated<\/p>\n
 be issued by the Tahsildar. He enclosed a<\/p>\n
copy the  chit issued by the Tahsildar on 08.12.1989<\/p>\n
 Form”  in respect of his claim that the land in question<\/p>\n
  ‘Wvas._pgranted in his favour. The Tahsildar has rejected the<\/p>\n
 -hvrequest observing that there was no record in his office<\/p>\n
  :regarding the grant of land in favour of the petitioner. He has<\/p>\n

\nfurther stated that even after searching the records of the year
\n1988-89, no records could be traced showing the grantgrnade in
\nfavour of the petitioner and in such circumstances :.re(:;’L1est<\/p>\n
made by the petitioner could not be acceded to.<\/p>\n
3. Learned counsel for the petitioner..has ifeliancelloriu ‘ ; it<\/p>\n
the saguvali chit issued vide AnneXure–E1._’_’  fa{cs:._”1ie <\/p>\n
before the Court, at the time ofgvlarguments, a copy of!’<\/p>\n
the saguvali chit which is issued_VVVby_ the Tah’sildar_:\u00a7and which
\nbears the seal of the office the  contend that the
\nrejection of his request  totally illegal and<\/p>\n
unjustified.\n<\/p>\n
4. It is seen’ ‘1*n_a’terials produced along with the writ<\/p>\n
petition that” the-. lpetitioinerherein had filed a suit in<\/p>\n
O.S.No.’2v96\/1\u00a790_againsi the third party alleging interference in<\/p>\n
  p’e’z-lceiful pcssessionmand enjoyment of the suit property and<\/p>\n
-decree of permanent injunction is obtained by<\/p>\n
  hirnin o:s;1\\i”c5.;2l96\/1990 on 25.05.1992. It is also clear from<\/p>\n
 — copy of the mahazar drawn by the revenue<\/p>\n
A  gllauytlioriiies that the petitioner is shown to have been in actual<\/p>\n
  spgos\u00e9session and enjoyment of portions of the lands in question.<\/p>\n
 ~ lit is also clear from Annexure–C — sketch prepared by the<\/p>\n

Revenue Inspector, Nandi Hobli, Chikballapur Taluk that the
\nland in possession of the petitioner is identified. H These<\/p>\n
documents have not been considered by the ‘Fahsi1d’a~rV,:’-..r_:il\\;rIe_re1y<\/p>\n
because the original records pertaining to the <\/p>\n
available with the Tahsildar, he cannot reject: thespof  <\/p>\n
petitioner, particularly when it is supportedthe’  <\/p>\n
of the saguvali chit issued  theV’7T_aVhsilda’r’.v’h’   jlactualv<\/p>\n
possession and enjoyment of thet”pr:operty2,”thVe_’duration of the
\npetitioners enjoyment ‘    _coupled with the
\ndocuments such as  prepared at an
\nundisputed and  receipt which is
\nproduced at\u20ac’ria\u00a7’o6;\u00a7989 have to be taken
\nnote of   action to record the name of
\nthe petitionerin based on these documents is<\/p>\n
required to be “~t_al:en. “The petitioner who is a poor farmer<\/p>\n
 V ‘cannot fmade to approach this Court time and again. In fact<\/p>\n
 “pe\u00a3iderrei=.s’.?~~ had approached earlier by filing<\/p>\n
 W.P.’i\\Io.3_849i4~\/A2009 and this Court passed an order on<\/p>\n
 directing respondent No.4 – Tahsildar to consider<\/p>\n
 dthe -reijuest of the petitioner for change of khatha. Pursuant to<\/p>\n
  p  directions, only the impugned order is passed.<\/p>\n

5. The impugned order as already observed does not take
\nnote of the relevant materials. Hence, the same is set__ aside.<\/p>\n

the petitioner in the khatha in acmrdanccri ‘<\/p>\n
