DAVE\n\t\t\n\t\n\n \n\nDate\n: 21\/09\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tlearned Advocates for the parties.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. I.S. Supehia for the petitioner would contend that by<br \/>\n\tan order dated 17.10.2005, the order of dismissal dated 28.05.2001<br \/>\n\tcame to quashed and set aside and the petitioner was awarded 35% of<br \/>\n\ttotal back-wages.  However, on perusal of the above order and<br \/>\n\tdirections contained in Paragraph 11 and subsequently, in the order<br \/>\n\tdated 10.09.2008 passed in Special Civil Application No.9873\/2008 by<br \/>\n\tthe learned Single Judge, final decision was to be taken about the<br \/>\n\tstatus of the petitioner.  Subsequently, as per the order dated<br \/>\n\t20.09.2008 a penalty of reversion in the pay scale for a period of<br \/>\n\ttwo years was imposed and the departmental inquiry as ordered in<br \/>\n\tParagraph 11 of the order dated 17.10.2005 was finally concluded.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate for the petitioner has placed reliance on Rule 31(1) of<br \/>\n\tGujarat Civil Service (Pension) Rules, 2002 and has submitted that<br \/>\n\tif the government employee is dismissed and reinstated on order in<br \/>\n\tappeal, such employees would be entitled to count his past service<br \/>\n\tas qualifying service. In the facts of the case, upon setting aside<br \/>\n\tthe order of dismissal of the petitioner, period of past service is<br \/>\n\tto be treated by respondent authorities towards qualifying service<br \/>\n\tin absence of any specific order passed about break in service, by<br \/>\n\tthe authority in accordance with law.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate for the respondent to take specific instructions to file a<br \/>\n\treply on the above aspect including order of imposing penalty and<br \/>\n\treversion in pay scale for two years by an order dated 20.09.2008.\n<\/p>\n<p>Matter<br \/>\n\tto be listed on 17th<br \/>\n\tOctober, 2011.\n<\/p>\n<p>\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>(Anant<br \/>\nS.
