PUBLIC PROSECUTOR\nfor Respondent(s) : 1, \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 12\/09\/2011\n \n\nORAL\nORDER<\/pre>\n<p>Rule.\n<\/p>\n<p>\tMr.Maulik Nanavati, learned<br \/>\n\tAdditional Public Prosecutor, waives service of notice of Rule on<br \/>\n\tbehalf of the respondent-State.\n<\/p>\n<p>By<br \/>\n\tway of present application, the applicant has prayed to release him<br \/>\n\ton temporary bail for one month on the ground of sickness of his<br \/>\n\twife.\n<\/p>\n<p>Heard<br \/>\n\tMr.Kantilal Kayastha, learned counsel for the applicant and<br \/>\n\tMr.Maulik Nanavati, learned Additional Public Prosecutor for the<br \/>\n\trespondent-State.\n<\/p>\n<p>Mr.Kayastha,<br \/>\n\tlearned counsel for the applicant, submits that the wife of the<br \/>\n\tapplicant is suffering from sub acute Appendicitis and C.M.O. of the<br \/>\n\tGovind Prabha Arogya Sankool, Surat has advised for operation and is<br \/>\n\tfixed on 16th September, 2011. He has also contended that<br \/>\n\tthere is no one in the family except a small baby aged 2 years 9<br \/>\n\tmonths to look after his wife. He, therefore, contended that<br \/>\n\tpresence of the applicant is necessary and therefore, prayed to<br \/>\n\trelease the applicant on temporary bail for one month.\n<\/p>\n<p>Heard<br \/>\n\tMr.Nanavati, learned Additional Public Prosecutor and also perused<br \/>\n\tpapers. It appears from the Certificate issued by the C.M.O. of the<br \/>\n\tGovind Prabha Arogya Sankool, Surat that operation is required and<br \/>\n\tis fixed on 16th September, 2011. It also appears from<br \/>\n\tthe papers that there is no one except the applicant in the family<br \/>\n\tto look after his wife.\n<\/p>\n<p>In<br \/>\n\tview of above, present application is partly allowed. The applicant<br \/>\n\tis ordered to be released on temporary bail from 16th<br \/>\n\tSeptember, 2011 for 15 days on his furnishing a personal bond in the<br \/>\n\tsum of Rs.5,000\/- (Rupees Five Thousand Only) before the Jail<br \/>\n\tAuthority on usual terms and conditions. The applicant is directed<br \/>\n\tto surrender himself before the Jail Authority on 30th<br \/>\n\tSeptember, 2011 on or before 05.30 p.m. Rule is made absolute to the<br \/>\n\taforesaid extent.\n<\/p>\n<p>Direct<br \/>\n\t\t\tService is permitted.\n<\/p>\n<p>(Z.\n<\/p>\n<p>K.
