No.824 of 2009<\/p>\n<p>          The plaintiff\/respondent filed a suit for recovery on the<\/p>\n<p>basis of pronote under the provisions of Order 37 of the Code of Civil<\/p>\n<p>Procedure. The appellants, who were defendants, moved an<\/p>\n<p>application for leave to defend within the stipulated period and the<\/p>\n<p>same was allowed subject to their furnishing adequate security. The<\/p>\n<p>appellants failed to furnish the same within the time frame granted by<\/p>\n<p>the learned trial Court leaving the Court with no other option but to<\/p>\n<p>proceed with the case by treating the application for leave to defend<br \/>\n<span class=\"hidden_text\"> R.S.A. No.824 of 2009 (O&amp;M)                         -2-<\/span><\/p>\n<p>as withdrawn.\n<\/p>\n<p>            The suit was ultimately decreed as the evidence produced<\/p>\n<p>before the learned trial Court pointed to the validity of the pronote.<\/p>\n<p>            In appeal, the findings of the learned trial Court were<\/p>\n<p>affirmed.\n<\/p>\n<p>            The learned counsel for the appellants has assailed the<\/p>\n<p>aforesaid findings to contend that the appellants were precluded from<\/p>\n<p>furnishing the security pursuant to the orders passed on the<\/p>\n<p>application for leave to defend as the appellant No.2 was residing<\/p>\n<p>abroad.\n<\/p>\n<p>            After hearing the learned counsel for the appellants, I am<\/p>\n<p>of the opinion that the plea as raised by the learned counsel for the<\/p>\n<p>appellants is totally misplaced. The suit was concededly filed under<\/p>\n<p>the provisions of Order 37 of the Code of Civil Procedure in which an<\/p>\n<p>application for leave to defend was moved. The said application was<\/p>\n<p>allowed subject to furnishing of security which was not deposited by<\/p>\n<p>the appellants. The reason given for not depositing the security is that<\/p>\n<p>the appellant No.2 was residing abroad. I am afraid such an excuse<\/p>\n<p>cannot be accepted at this belated stage. If the appellant No.2 was<\/p>\n<p>residing abroad, it was for him to make some arrangement to<\/p>\n<p>prosecute the case effectively, which was not done. The learned trial<\/p>\n<p>Court even otherwise on the basis of evidence before it concluded<\/p>\n<p>regarding the validity of the pronote and its execution by the<\/p>\n<p>appellants. The said findings were affirmed by the first Appellate<\/p>\n<p>Court. In this view of the matter, when pure questions of fact have<\/p>\n<p>been determined by the Courts below and no substantial question of<br \/>\n<span class=\"hidden_text\"> R.S.A.
