Justice K.R.UDAYABHANU\n\n Dated :07\/03\/2007\n\n O R D E R\n                             K.R.UDAYABHANU, J\n\n                        ---------------------------------------------\n\n                              Crl.R.P.No.794 of 1999\n\n                         ---------------------------------------------\n\n                    Dated this the 7th day of March, 2007\n\n\n\n\n                                        ORDER\n<\/pre>\n<p>       Revision petitioner is the defacto complainant in C.C.52\/93<\/p>\n<p>in the file  of the JFCM-III, Palakkad with respect to the offence<\/p>\n<p>under   Section   381   and   414   IPC.     The   court   below   as   per   the<\/p>\n<p>order dated 19.2.1999  acquitted the accused in  the  light of the<\/p>\n<p>ratio of the decision in  Raj Deo Sharma vs. State of Bihar  (1998<\/p>\n<p>(2) KLJ 815 SC).   It is challenging the above order of the court<\/p>\n<p>below that the revision petition has been filed.<\/p>\n<p>       2.    Subsequently, the  larger bench  of the supreme  court<\/p>\n<p>as per the judgment in  Ramachandra Rao vs. State of Karnataka<\/p>\n<p>(2002(2) KLT 189 SC) reversed ratio of the decision in Raj Deo<\/p>\n<p>Sharma&#8217;s   case   (op.cit).     In   the   circumstances,   the   order   of   the<\/p>\n<p>court   below   acquitting   the   accused   on   the   basis   of   the   ratio   of<\/p>\n<p>the   above   decision   cannot   be   sustained.     In   the   result,   the<\/p>\n<p>judgment of the JFCM is set aside.   The court below is directed<\/p>\n<p>to   further   proceed   with   the   trial.     The   accused   shall   appear<\/p>\n<p>before the Judicial First Class Magistrate Court-III,  Palakkad  on<\/p>\n<p>CRRP794\/99                         -2-\n<\/p>\n<p>25.4.2007.
