SIRIJAGAN, J.\n                 -------------------------------------\n                  WP(C) No. 40442 of 2003\n                 ---------------------------------------\n            Dated this the 20th day of July, 2010\n\n                        J U D G M E N T\n<\/pre>\n<p>                        &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>     The petitioner&#8217;s contention in this writ petition is as<\/p>\n<p>follows:-\n<\/p>\n<p>     2. In 1930 the petitioner&#8217;s grand father one Mr.<\/p>\n<p>Pulipura Mohammed Malmi got certain lands in the Suheli<\/p>\n<p>Cheriyankara island on lease from the Lakshadweep<\/p>\n<p>Administration. After the death of his grand father the<\/p>\n<p>petitioner and two other persons became the lessee in<\/p>\n<p>1985, is the contention of the petitioner. The lease was<\/p>\n<p>granted by the Lakshadweep Administration for a period<\/p>\n<p>of five years to the 4th respondent on 25.02.1985. Against<\/p>\n<p>that order of granting lease in favour of the 4th<\/p>\n<p>respondent, the petitioner had filed an appeal before the<\/p>\n<p>Administration. This Court in judgment in O.P.No.3488\/85<\/p>\n<p>directed the Administrator to consider that appeal. That<\/p>\n<p>appeal was rejected.        Against the order            rejecting the<\/p>\n<p><span class=\"hidden_text\">                                2<\/span><br \/>\nWP(C) No. 40442 of 2003<\/p>\n<p>appeal, the petitioner filed OP No.7233\/91. The order<\/p>\n<p>challenged was stayed by this Court.         Ultimately by<\/p>\n<p>judgment dated 29.05.1998 the original petition was<\/p>\n<p>dismissed by pointing out that the land being Government<\/p>\n<p>land and the 4th respondent being a landless person, in<\/p>\n<p>contradiction       to the petitioner who is not a landless<\/p>\n<p>person and there is nothing wrong in giving the land on<\/p>\n<p>lease to the 4th respondent in so far as the lease is in<\/p>\n<p>terms of the Lakshadweep Land Revenue and Tenancy<\/p>\n<p>Regulation, 1965. Petitioner did not choose to challenge<\/p>\n<p>that judgment in appeal and the same has become final.<\/p>\n<p>Further he filed a representation before the first<\/p>\n<p>respondent pointing out that after the judgment dated<\/p>\n<p>29.05.1998, Exhibit P2 dated 14.07.1998 was executed in<\/p>\n<p>favour of the 4th respondent, which would show that she<\/p>\n<p>was not a landless person.            The petitioner filed<\/p>\n<p>O.P.No.19683\/2000 before this Court in which by Exhibit<\/p>\n<p>P3 judgment,         Exhibit P1 appeal was directed to be<\/p>\n<p><span class=\"hidden_text\">                              3<\/span><br \/>\nWP(C) No. 40442 of 2003<\/p>\n<p>disposed of. Pursuant to that, Exhibit P6 order has been<\/p>\n<p>passed by the Administrator of the Lakshadweep<\/p>\n<p>Administration. In that order after quoting the judgment<\/p>\n<p>in O.P No. 7233\/91 and after expressing some doubts as<\/p>\n<p>to whether the 4th respondent is a landless person, the<\/p>\n<p>administrator dismissed the appeal in view of the<\/p>\n<p>judgment in OP 7233\/91. That order is under challenge<\/p>\n<p>before me, in this writ petition.\n<\/p>\n<p>      3. The contention of the petitioner is that the<\/p>\n<p>judgment in O.P.No. 7233\/91 was rendered on a mistake<\/p>\n<p>finding that the 4th respondent is a landless person which<\/p>\n<p>is not as is evidenced by Exhibit P2 gift deed executed<\/p>\n<p>barely, 1= months after the judgment in OP No. 7233\/91.<\/p>\n<p>He would submit that therefore after finding that the 4th<\/p>\n<p>respondent is not a landless lady, the first respondent<\/p>\n<p>could not have validly rejected the appeal.<\/p>\n<p>      4. I have considered the contentions of the parties.<\/p>\n<p>None of the respondents have filed any counter affidavit.<\/p>\n<p><span class=\"hidden_text\">                               4<\/span><br \/>\nWP(C) No. 40442 of 2003<\/p>\n<p>I am of the opinion that in so far as the judgment in<\/p>\n<p>O.P.No.7233\/91 upholding the lease in favour of the 4th<\/p>\n<p>respondent has become final, this Court cannot again<\/p>\n<p>reconsider the issue and come to a different finding. Of<\/p>\n<p>course the learned counsel for the petitioner pointed out<\/p>\n<p>that in Exhibit P3 judgment this Court had directed<\/p>\n<p>consideration of Exhibit P1 appeal notwithstanding the<\/p>\n<p>judgment in O.P.No.7233\/91. I am of opinion that, that<\/p>\n<p>does not mean that the appeal has to be considered<\/p>\n<p>notwithstanding        the earlier judgment.    Exhibit   P3<\/p>\n<p>judgment only directs consideration of Exhibit P1 appeal.<\/p>\n<p>Such consideration can only be in accordance with law.<\/p>\n<p>The law is that the petitioner cannot reagitate the matter<\/p>\n<p>because of principles of resjudicata. The petitioner cannot<\/p>\n<p>reagitate the issue regarding the validity of lease in<\/p>\n<p>favour of the 4th respondent again by filing another appeal<\/p>\n<p>before the first respondent. It is not as if the petitioner is<\/p>\n<p>a landless person. Admittedly the petitioner also holds<\/p>\n<p><span class=\"hidden_text\">                              5<\/span><br \/>\n WP(C) No. 40442 of 2003<\/p>\n<p> land on lease from the Government. As such on equity<\/p>\n<p> also there is no merit in the contentions of the petitioner.<\/p>\n<p> As such there is nothing to choose between the petitioner<\/p>\n<p> and the 4th respondent. In any event after suffering the<\/p>\n<p> judgment in O.P.No.7233\/91, the petitioner cannot<\/p>\n<p> reagitate the issue again without challenging that<\/p>\n<p> judgment. In Exhibit P6 order also the same view has<\/p>\n<p> been taken. I cannot fault the same. Therefore there is<\/p>\n<p> no merit in this writ petition and accordingly, the same is<\/p>\n<p> dismissed.\n<\/p>\n<\/p>\n<p>                                         S.
