Justice R.BASANT\n\n Dated :02\/07\/2007\n\n O R D E R\n                                 R.BASANT, J.\n\n                              ----------------------\n\n                            B.A.No. 3977 of 2007\n\n                        ----------------------------------------\n\n                   Dated this the 2nd  day of July 2007\n\n\n\n\n                                   O R D E R\n<\/pre>\n<p>      Application   for   anticipatory   bail.     The   petitioners   are<\/p>\n<p>accused   1   to   3.     They   face   allegations   under   Sections   353   and<\/p>\n<p>294(b)   read   with   34   I.P.C.     The   crux   of   the   allegations   raised<\/p>\n<p>against   the   petitioners   is   that   they,   who   were   proceeding   on   a<\/p>\n<p>motor   cycle,   assaulted   an   Assistant   Sub   Inspector   of   Police   on<\/p>\n<p>duty   who   wanted   to   restrain   the   petitioners   from   proceeding<\/p>\n<p>further along a public road in the light of a procession which was<\/p>\n<p>to   take   place.     The   petitioners   allegedly   became   furious   when<\/p>\n<p>they were asked not to proceed.  One of them allegedly shouted,<\/p>\n<p>abusive   and   obscene   words   and   pushed   away   the   hand   of   the<\/p>\n<p>police officer who tried to restrain them.       Thereupon, a crime<\/p>\n<p>was registered against these persons showing the number of the<\/p>\n<p>motor   cycle.     Later,   the   petitioners   were   ascertained   as   the<\/p>\n<p>accused   and   necessary   report   to   that   effect   was   given.\n<\/p>\n<p>Investigation   is   in   progress.              The   petitioners   apprehend<\/p>\n<p>imminent arrest.\n<\/p>\n<p><span class=\"hidden_text\">B.A.No.3977\/07                           2<\/span><\/p>\n<p>      2.     The   learned   counsel   for   the   petitioners   submits   that<\/p>\n<p>the allegations are totally false.   The incident did not take place<\/p>\n<p>in   the   manner   alleged   by   the   complainant   at   all.     There   was  a<\/p>\n<p>procession  and the traffic was being unjustifiably obstructed by<\/p>\n<p>the   police.   On   that   aspect,   there   was   a   wordy   altercation.   The<\/p>\n<p>present   crime   has   hence   been   raised   by   the   A.S.I   against   the<\/p>\n<p>petitioners.\n<\/p>\n<p>      3.     The   application   is   opposed   by   the   learned   Public<\/p>\n<p>Prosecutor.     The   learned   Public   Prosecutor   submits   that   there<\/p>\n<p>are no circumstances justifying the invocation of the jurisdiction<\/p>\n<p>under   Section   438   Cr.P.C.     There   is   absolutely   no   mala   fides<\/p>\n<p>involved as can be seen by the registration of the F.I.R wherein<\/p>\n<p>the number of the motor cycle and not the name of the accused<\/p>\n<p>is shown.\n<\/p>\n<p>      4.     I   find   merit   in   the   opposition   by   the   learned   Public<\/p>\n<p>Prosecutor.  I do not find any reason to permit the petitioners to<\/p>\n<p>arm themselves with an order of anticipatory bail.  I am satisfied<\/p>\n<p>that,   in   the   facts   and   circumstances   of   this   case,   to   allay   the<\/p>\n<p>apprehension   of   physical   harm   and   torture,   the   petitioners   can<\/p>\n<p>be given an opportunity to appear before the learned Magistrate<\/p>\n<p><span class=\"hidden_text\">B.A.No.3977\/07                              3<\/span><\/p>\n<p>and seek regular bail  in the ordinary course.   The  possibility of<\/p>\n<p>their  being arrested and detained  in  police custody before  they<\/p>\n<p>get   an   opportunity   to   approach   the   learned   Magistrate   for   bail<\/p>\n<p>can be so avoided in the peculiar facts and circumstances of this<\/p>\n<p>case.\n<\/p>\n<p>         5.     In   the   result,   this   petition   is   allowed.
