Collector, Petlad respectively, was confirmed.\n<\/p>\n<p>2.\tThe<br \/>\nfacts in brief are that deceased, Shankerbhai Nathabhai Patel, the<br \/>\npredecessor of the petitioners, was cultivating the lands bearing<br \/>\nsurvey nos.7, 151\/1-A-B, 160\/1, 160\/3, 267\/1\/A-B-C, 269\/5 &amp; 288\/1<br \/>\nof Village Saijpur, Taluka Borsad, District Kaira. In proceedings<br \/>\ninitiated u\/s.32-G of the Bombay Tenancy and Agricultural Lands Act,<br \/>\nthe Mamlatdar &amp; ALT held that the deceased was not a &#8216;tenant&#8217; of<br \/>\nthe lands in question, vide order dated 31.01.1983 passed in Tenancy<br \/>\nCase No.40\/1979.\n<\/p>\n<p>3.\tAgainst<br \/>\nthe said order, Tenancy Appeal No.39\/1983 was filed before the Dy.<br \/>\nCollector, Petlad, who dismissed the said appeal, vide order dated<br \/>\n10.10.1984. Being aggrieved by the same, the petitioners preferred<br \/>\nRevision Application No. TEN.B.A. 70 of 1985 before the Tribunal. The<br \/>\nTribunal, vide judgment and order dated 31.12.1993, dismissed the<br \/>\nsaid revision application. Review Application preferred pursuant to<br \/>\nthe said order also came to be rejected vide order dated 14.10.1994.<br \/>\nHence, this petition.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. After appreciating the evidence on record, the<br \/>\nrespondent-authorities found that except the revenue entries, there<br \/>\nis no other evidence on record to show that the deceased, original<br \/>\napplicant, was occupying the land in question as a &#8216;tenant&#8217;. Thus,<br \/>\nhis possession as a &#8216;tenant&#8217; was not believed by the authorities.<br \/>\nFurther, the disputed lands were jointly purchased by the deceased,<br \/>\noriginal applicant along with original opponent no.7. Looking to the<br \/>\nfacts of the case and the evidence on record, I am of the view that<br \/>\nthe authorities below have rightly not believed the case of the<br \/>\npetitioners. I am in complete agreement with the concurrent findings<br \/>\nrecorded by the authorities \/ Tribunal below and hence, find no<br \/>\nreasons to interfere in this petition.\n<\/p>\n<p>5.\tFor<br \/>\nthe foregoing reasons, the petition is dismissed.
