Kapadia for the applicant,<br \/>\nat the outset, submitted that the applicant has not committed any<br \/>\noffence as alleged against him. Considering the role attributed to<br \/>\nthe applicant which is reflected in the F.I.R. at Annexure A to the<br \/>\napplication, he deserves to be enlarged on bail.\n<\/p>\n<p>3.\tLearned A.P.P.\n<\/p>\n<p>Ms.M.L. Shah, representing the respondent-State, while opposing the<br \/>\nbail application, submitted that considering the role attributed to<br \/>\nthe applicant and the manner in which the alleged offence is<br \/>\ncommitted by him, no discretionary relief be granted to him and the<br \/>\napplication be dismissed.\n<\/p>\n<p>4.\tI have heard learned<br \/>\nadvocate Mr.Arpit A. Kapadia for the<br \/>\napplicant and learned A.P.P. Ms.M.L. Shah for the respondent-State at<br \/>\nlength and in great detail. Considering the rival submissions, role<br \/>\nattributed to the applicant, provisions of Sections 395 and 397 of<br \/>\nthe Indian Penal Code, police papers, quantum of punishment  and<br \/>\nconsidering the fact that nothing is recovered from the applicant, I<br \/>\nam of the view that the applicant deserves to be enlarged on bail.\n<\/p>\n<p>5.\tIn the facts and<br \/>\ncircumstances of the case, the application is allowed and the<br \/>\napplicant is ordered to be enlarged on bail in connection with<br \/>\nC.R.No.I 31 of 2002 registered at Bhachhau Police Station, Kachchh<br \/>\non executing a bond of Rs.10,000\/- [Rupees ten thousand only] with<br \/>\none surety of the like amount to the satisfaction of the Trial Court<br \/>\nand subject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot take undue<br \/>\nadvantage of his liberty or abuse \this liberty;\n<\/p>\n<p>[b]\tnot act in a manner<br \/>\ninjurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender his<br \/>\npassport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot leave the State<br \/>\nof Gujarat without the prior permission of the Sessions court<br \/>\nconcerned;\n<\/p>\n<p>[e]\tmark his presence at<br \/>\nthe concerned Police Station on any day of every first week of<br \/>\nEnglish calendar month between 9.00 AM and 2.00 PM. till the trial is<br \/>\nover;\n<\/p>\n<p>[f]\tfurnish the present<br \/>\naddress of his residence to the I.O. and also to the Court at the<br \/>\ntime of execution of the bond and shall not change his residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>[g]\tmaintain law and<br \/>\norder.\n<\/p>\n<p>6.\tIf breach of any of<br \/>\nthe above conditions is committed, the Sessions Judge concerned will<br \/>\nbe free to issue warrant or to take appropriate action in the matter.\n<\/p>\n<p>7.\tBail bond to be<br \/>\nexecuted before the lower Court having jurisdiction to try the case.\n<\/p>\n<p>8.\tAt the trial, the<br \/>\nTrial Court shall not be influenced by the observations of<br \/>\npreliminary nature, qua the evidence at this stage, made by this<br \/>\nCourt while enlarging the applicant on bail.\n<\/p>\n<p>9.\tRule<br \/>\nis made absolute to the aforesaid extent.
